'%®�* vko' //N 111111 N 111 8 WHEREAS, the property owner located at 1117 Rose Street, along with other adjoining property 9 owners, filed a petition to abandon portions of the fifteen (15) -foot wide alley right-of-way located within 10 Block 16, Hillcrest Addition, adjacent to 1117 Rose Street; and, 11 WHEREAS, the Board has determined that abandoning a portion of the alley located within Block 12 16, Hillcrest addition adjacent to 1117 Rose Street will not have an adverse impact on the adjacent 13 owners nor the public safety, health or welfare, and therefore, the portion of the alley abandoned by this 14 ordinance is no longer needed for corporate purposes except as otherwise noted below; and, 15 WHEREAS, the areas of alley right-of-way abandonment shall be retained as public Utility 16 Easements. 17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 18 OF LITTLE ROCK, ARKANSAS: 19 Section 1. The City of Little Rock, hereby releases, vacates, and abandons the following alley right - 20 of -way, less and except the reserved public Utility Easements. The two (2) sections requested for 21 abandonment are as follows: 22 1) Fifteen (15) -foot wide by 150.3 foot alley right-of-way located on the south side of Lot 15, 23 Block 16, Hillcrest Addition (1117 Rose Street); and, 24 2) Fifteen (15) -foot wide by 42.7 foot alley right-of-way located on the north side of Lot 15, Block 25 16, Hillcrest Addition (1117 Rose Street). 26 Section 2. A copy of this ordnance duly certified by the City Clerk, shall be filed in the real estate 27 records of the recorder of the Circuit Clerk in Ex -Officio Recorder of Pulaski County, Arkansas. 28 Section 3. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, 29 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or 30 unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this 31 ordinance, as if such invalid or unconstitutional provision was not originally a part of this ordinance. 32 Section 4. Repealer.
