The motion was seconded by Director Scheibner and unanimously adopted by the Board Members present, being ten in number and two - thirds or more of the members of the Board of Directors - elect. Following the second reading of the Ordinance, there was a subsequent motion and second by Directors Mason and Scheibner, respectively, to again suspend the rules and place the Ordinance on third and final reading. The motion was unanimously adopted by the Board Members present, being ten in number and two - thirds or more of the members of the Board of Directors - elect. The Ordinance was read the third and last time, followed by a roll call vote on passage of the Ordinance: Ayes - Directors Joyce, Roy, Sharp, Lewellen, Mason, Mayor Dailey, Directors Adcock, Hendrix, Scheibner and Keck - total 10; Noes - None; Absent - Director Priest - total 1. Therefore, the Ordinance was declared PASSED. A public hearing had been scheduled for this time and place by Resolution No. 9,144, adopted April 19, 1994, and notice thereof duly published on April 26, 1994, and May 3, 1994, on the petition to vacate and close all of an east west alley and a portion of a north south alley in Block 3 of the Oak Forest Addition to the City of Little Rock, Arkansas, and to abandon the public utility easements located within those alley rights -of- way. The petition was filed by Mr. Frank Riggins, Mehlburger Engineers, on behalf of Charles J. Enderlin, Robert Wetzel, Bert O. Miller, and Aline F. Miller. Attached to the petition was a certified copy of the plat of Oak Forest Addition on file in the Pulaski County Circuit Clerk's Office and a letter from Standard Abstract & Title Company listing the last apparent owners of record of abutting property. The right -of -way abandonment was approved by the Planning Commission on April 5, 1994. Mayor Dailey declared the public hearing open. Mr. Jim Hathaway explained that this right -of -way abandonment is related to the reclassification of the Walgreen's site at West 12th Street and Fair Park Boulevard (see Ordinance No. 16,646). No one was present to speak in opposition to the abandonment. Mayor Dailey declared the public hearing closed and Ordinance No. 16,650 was introduced, with the following caption: AN ORDINANCE VACATING AND CLOSING ALL OF AN EAST WEST ALLEY AND A PORTION OF A NORTH SOUTH ALLEY IN BLOCK 3 OF THE OAK FOREST ADDITION TO THE CITY OF LITTLE ROCK, AND TO ABANDON THE PUBLIC UTILITY EASEMENTS LOCATED WITHIN THOSE ALLEY RIGHTS -OF -WAY; and there was a first reading of the Ordinance. Consideration was then given to Zoning Application Z -5808 filed by Muskie Harris, applicant, on behalf of International Paper Company to rezone 1.71 acres at Asher Avenue and Adams Street from 11I -2" Industrial Park District to 11C -3" General Commercial District for use as a private club and multi - purpose special events center. The reclassification was approved by the 10 612 Minutes May 3, 1994 Planning Commission on April 5, 1994. Ordinance No. 16,651 was presented, with the title being: AN ORDINANCE RECLASSIFYING PROPERTY LOCATED IN THE CITY OF LITTLE ROCK, ARKANSAS; AMENDING SECTION 36 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES; (2-5808 - To rezone 1.71 acres at Asher Avenue and Adams Street from 11I -2" Industrial Park District to 11C -3" General Commercial District.) and the Ordinance was read the first time. Mr. Muskie Harris, applicant, explained this would be a multi - purpose special events center /private club in the old Long Bell Lumber Company facility, which was abandoned by International Paper Company about ten years ago. Mr. Harris responded to questions by the Board of Directors. Mr. Richard Brittain, 503 E. 6th Street, #309, said this sounds like an attempt to come up with an illegal commercial bingo hall. There was a motion by Director Keck, seconded by Director Lewellen, to suspend the rules and place the Ordinance on second reading. The motion was unanimously adopted by the Board Members present, being ten in number and two - thirds or more of the members of the Board of Directors - elect, and the second reading of the Ordinance ensued. There was a subsequent motion by Director Mason, seconded by Director Hendrix, to again suspend the rules and place the Ordinance on third and final reading. Whereupon, the Ordinance was declared PASSED. Consideration was then given to Ordinance No. 16,652, described as: AN ORDINANCE TO AMEND THE MASTER STREET PLAN, REDUCING THE DESIGN STANDARD FOR CHENAL /FINANCIAL CENTER PARKWAY AND FOR OTHER MATTERS. (To require a four lane section and 100 foot right -of -way from Kanis Road east to Shackleford Road; the divided principal arterial (parkway) right -of -way is reduced to principal arterial standard, with median reduced to 14 feet.) The first speaker was Mrs. Ruth Bell, representing the League of Women Voters of Pulaski County. Ms. Bell asked the Board to undertake a plan to handle the tremendous traffic on Chenal Parkway as it exists now and by 1996 will be gridlocking that area. Mr. Ray Metzger, 11905 Desoto Forest Drive, spoke in support of the Ordinance and gave a brief history of the planning and development of Chenal Parkway, stating that the initial phase of Chenal Parkway that was put together was a beautiful master zoning plan, but the City destroyed the original connection proposed by the Arkansas Highway Department that would have dispersed the traffic off the Parkway. Mayor Dailey asked Mr. Metzger if he would be willing to serve in some capacity working with staff on a traffic study of Chenal Parkway, and Mr. Metzger agreed to do so. The Ordinance was then read the first time. There was a motion by Director Roy, seconded by Director Adcock, to suspend the rules and place the Ordinance on second reading. The motion was adopted unanimously by the Board Members present, being ten in number and two - thirds or more of the members of the Board of Directors - elect, and the second reading of the Ordinance ensued.
