15323 1 RESOLUTION NO. 15,323 2 3 A RESOLUTION TO AUTHORIZE THE MAYOR AND CITY CLERK TO 4 EXECUTE ANY DOCUMENTS REQUIRED TO TRANSFER THE TITLE 5 OF TWO (2) PROPERTIES BETWEEN THE CITY OF LITTLE ROCK, 6 ARKANSAS, AND HAYBAR PROPERTIES, LLC; AND FOR OTHER 7 PURPOSES. 8 9 WHEREAS, Haybar Properties, LLC ("Haybar"), has expressed an interest and need for property 10 currently owned by the City of Little Rock,Arkansas("the City"), located in the W 38' of Lot 10 Block 4, 11 Garlands Addition to the City of Little Rock, Pulaski County, Arkansas, otherwise known as Parcel No. 12 34L0030004400("City Property"); and, 13 WHEREAS, the City has expressed an interest and need for property currently owned by Haybar 14 located in the 25'N&S BY 90' E&W IN SE COR E 1/3 OF N 1/2 OF Block 6,Garlands Addition to the 15 City of Little Rock, Pulaski County, Arkansas, otherwise known as Parcel No. 34L0030006100 ("Haybar 16 Property"); and, 17 WHEREAS,Haybar has agreed to exchange the Haybar Property for the City Property;and, 18 WHEREAS,the City has agreed to exchange the City Property for the Haybar Property. 19 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 20 OF LITTLE ROCK,ARKANSAS: 21 Section 1. The Mayor and City Clerk, pursuant to the provisions of Ark. Code Ann. § 14-54-302(b) 22 (West 2004), are authorized to execute any documents required to transfer title of the properties between 23 the City and Haybar("The Parties"),which are more particularly described as: 24 City Property: W 38' of Lot 10 Block 4,Garlands Addition to the City of Little Rock, Pulaski County, 25 Arkansas,otherwise known as Parcel No. 34L0030004400; 26 Haybar Property: 25'N&S BY 90'E&W IN SE CORE 1/3 OF N 1/2 OF Block 6,Garlands Addition 27 to the City of Little Rock, Pulaski County, Arkansas,otherwise known as Parcel No.34L0030006100. 28 Section 2. The parties agree to exchange the properties for equal value, with no monetary 29 consideration being paid other that the value of the properties. 30 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 31 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 32 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 33 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 34 resolution. All laws, ordinances, resolutions, or parts of the same that are inconsistent with 2 the provisions of this resolution are hereby repealed to the extent of such inconsistency. 3 ADOPTED.
