3 A RESOLUTION TO AUTHORIZE A THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH ESCAMILLA EXCAVATING LLC, IN AN
5 AMOUNT NOT TO EXCEED TWO HUNDRED FORTY-THREE
6 THOUSAND, THREE HUNDRED EIGHTY-TWO AND 80/100 DOLLARS
7 ($243,382.80), FOR THE YARBERRY LANE IMPROVEMENT PROJECT;
8 AND FOR OTHER PURPOSES.

10 WHEREAS,bids were solicited for Yarberry Lane Improvements, Project No. 7-17-ST-294, Bid No.
11 993;and,
12 WHEREAS, Escamilla Excavating LLC, was the lowest responsive, responsible bid meeting
13 specifications.
14 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
15 OF LITTLE ROCK,ARKANSAS:
16 Section 1. The City Manager is hereby authorized to execute an agreement with Escamilla Excavating
17 LLC, for the Yarberry Lane Improvements Project in an amount not to exceed Two Hundred Forty-Three
18 Thousand,Three Hundred Eighty-Two and 80/100 Dollars($243,382.80),which is the base bid amount of
19 Two Hundred Two Thousand,Eight Hundred Nineteen Dollars($202,819.00),plus 20%contingencies.
20 Section 2. Funding for this project is from the%-Cent Capital Improvement Sales and Compensating
21 Use Tax Funds and the Limited Tax General Obligation Capital Improvement Bonds as authorized by
22 Resolution No. 14,803.
23 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
24 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
25 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
26 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
27 resolution.
28 Section 4. Repealer. All laws,ordinances,resolutions,or parts of the same,that are inconsistent with
29 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
