15299 1 RESOLUTION NO. 15,299 2 3 A RESOLUTION AUTHORIZING THE CITY MANAGER TO AMEND 4 THE CONTRACT WITH JAMES A.ROGERS EXCAVATING,INC.,IN AN 5 AMOUNT NOT TO EXXCEED SEVEN HUNDRED TWENTY THOUSAND 6 DOLLARS ($720,000.00), FOR THE CONSTRUCTION OF THE CITY OF 7 LITTLE ROCK CLASS 1 LANDFILL CELL 5 WEST; AND FOR OTHER 8 PURPOSES. 9 10 WHEREAS,bids were solicited for improvements for the City of Little Rock Class I Landfill Cell 5 11 West Construction,Bid No. 61 7; and, 12 WHEREAS, James A. Rogers Excavating, Inc., was the lowest responsive, responsible bid meeting 13 specifications; and, 14 WHERAS, it is desirable to increase the contract amount authorized under Resolution No. 15,073 to 15 provide for construction services necessary to complete the construction of the City of Little Rock Class 1 16 Cell 5 West. 17 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 18 OF LITTLE ROCK,ARKANSAS: 19 Section 1. The City Manager is hereby authorized to approve an amendment to the contract with James 20 A. Rogers Excavating, Inc., for Construction Services and to increase the contract amount from the 21 previously authorized Four Million,Four Hundred Forty Thousand,Five Hundred Seventy-Five and 23/100 22 Dollars($4,440,575.23)by Seven Hundred Twenty Thousand Dollars($720,000.00)to a new contract total 23 of Five Million, One Hundred Sixty Thousand, Five Hundred Seventy-Five and 23/100 Dollars 24 ($5,160,575.23). 25 Section 2. The cost for the contract will be funded from the Solid Waste Enterprise Fund, Special 26 Capital Improvement Activity No. S40A561. 27 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 28 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 29 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 30 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 31 resolution. 32 Section 4. Repealer. All laws, ordinances,resolutions, or parts of the same,that are inconsistent with 33 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
