19517I 2 ORDINANCE NO. 19,517 3 AN ORDINANCE TO ABANDON AN ALLEY RIGHT -OF -WAY 4 LOCATED WITHIN BLOCK 78, ORIGINAL CITY OF LITTLE 5 ROCK, IN THE CITY OF LITTLE ROCK, AS A PUBLIC RIGHT -OF- 6 WAY, AND FOR OTHER PURPOSES. 7 8 WHEREAS, a request was made to abandon the North /South 20 -foot wide alley 9 right -of -way (20 feet by 300 feet) located within Block 78, Original City of Little Rock, 10 and being bounded by West Markham, West 2nd, Main and Louisiana Streets, pursuant 1 l to the City's general police power authority under Ark. Code Ann. § 14 -54 -104; 12 WHEREAS, the Board has determined that the abandoning of this public right - 13 of -way will not have an adverse impact on the adjacent property owners nor the local 14 traffic, and therefore, the right -of -way abandoned by this ordinance is no longer needed 15 for corporate purposes, except as otherwise noted below. 16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 17 OF THE CITY OF LITTLE ROCK, ARKANSAS: 18 Section 1. The Board of Directors hereby releases, vacates, and abandons the 19 North /South 20- foot -wide alley right -of -way (20 feet by 300 feet) located within Block 20 78, Original City of Little Rock, being bounded by West Markham, West 2nd, Main and 21 Louisiana Streets, together with the right of public in general, in the City of Little Rock, 22 Pulaski County, Arkansas. 23 Section 2. The City specifically reserves the public utility easements within the 24 former right -of -way. A copy of this ordinance duly certified by the City Clerk, shall be filed in the real estate records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas. Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional was not originally a part of the ordinance. Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
