4 WATER IMPROVEMENT DISTRICT #139 OF LITTLE ROCK TO THE POSITION PREVI-
5 OUSLY HELD BY JAMES A. HUFF; AND FOR OTHER PURPOSES.

7 WHEREAS, the Vimy Ridge Water Improvement District #1 39 of Little Rock was created by Little
8 Rock, Ark. Ordinance No. 14,699 (July 3, 1984), and
9 WHEREAS, there has been a vacancy on the board of the improvement district created by the
10 resignation of Commissioner James A. Huff, and
11 WHEREAS, Ark. Code Ann. §14-88-304 (West 2004) provides that in the event of a vacancy
12 created by the resignation of a commissioner, a replacement commissioner shall be appointed by
13 the Board of Directors of the City which created the improvement district, and
14 WHEREAS, the remaining commissioners and a majority of the property owners of the Vimy
15 Ridge Water Improvement District #1 39 of Little Rock have suggested a replacement for the com-
16 missioner vacancy.
17 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
18 ROCK, ARKANSAS:
19 Section 1. The Board of Directors of the City of Little Rock appoints Mr. Edward Fain, a prop-
20 erty owner and resident of the district, to a position as commissioner of Vimy Ridge water Im-
21 provement District No. 1 39 to replace Mr. James Huff who is resigning from the commission.
22 Section 2. The Board of Directors extends its appreciation to Mr. �ames Huff for his service as
23 a Commissioner. ` �

24 Section 3. Repea/er. All resolutions and parts of resolutions in conflict with th4� reso�ion are
