19501ORDINANCE NO. 19,501 AN ORDINANCE REPEALING ORDINANCE NO. 18,079, REVOKING A PLANNED COMMERCIAL DISTRICT TITLED THE VILLAGE AT CHENAL PCD, (Z -5936) LOCATED ON THE NORTHWEST CORNER OF RAHLING ROAD AND CHENAL PARKWAY IN THE CITY OF LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES (Z- 5936 -D). WHEREAS, on February 21, 1995, Ordinance No. 16,851 was passed by the Board of Directors of the City of Little Rock, Arkansas which established a Planned Commercial District titled The Village at Chenal PCD, (Z -5936) located on the Northwest corner of Rahling Road and Chenal Parkway, Little Rock, Arkansas; and WHEREAS, on January 9, 2006, the applicant submitted a request that the Planned Commercial District be revoked and the previous zoning of C -3, 0-2 and MF -18 Districts be restored. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Ordinance No. 16,851 is hereby repealed. SECTION 2. That the preliminary site development plan/plat approved by Ordinance No. 16,851 is hereby revoked. SECTION 3(a). That the PCD zoning classification of the following described property in the City of Little Rock, Arkansas is revoked and the former C -3 zoning classification is restored on the official zoning map as indicated below: Part of Section 36, T -2 -N, R -14 -W, Pulaski County, Arkansas, more particularly described as: Staring at the center of said Section 36; thence SO °45'34 "W along the North South center line of said Section 36, 1021.60 feet to a point; thence Northwesterly along the arc of a 2,864.79 foot radius curve to the left, having a chord bearing and distance of N22 055'54 "W, 873.62 feet to a point; thence N31 042'05 "W, 1565.59 feet to the point of beginning; thence S58 °00'56 "W 333.03 feet to a point; thence Southwesterly along the arc of a 1,432.39 foot radius curve to the left having a chord bearing and distance of S48 °00' 14 "W, 498.18 feet to a point; thence N58 05528 "W, 337.59 feet to a point; thence Northwesterly along the arc of a 409.25 foot radius curve to the left, having a chord bearing and distance of N67 °34 "37 "W, 127.86 feet to a point; thence N27 033'08 "E, 519.63 feet to a point; thence N57 °53'37 "E, 604.20 feet to a point; thence S31 °42'07 "E, 583.94 feet to the point of beginning, containing 12.3393 acres more or less. SECTION 4. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock and designated district map be and it is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 3 hereof. SECTION 5. That this Ordinance shall take effect and be in full force 30 days after the date of its passage and approval. SECTION 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 7. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
