19506ORDINANCE NO. 19,506 AN ORDINANCE APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED OFFICE DISTRICT TITLED MAGNOLIA TERRACE REVISED SHORT -FORM POD, (Z- 5718 -A), LOCATED AT 15100 AND 15104 CANTRELL ROAD, LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from POD to Revised POD: South Hill Terrace Addition, to the City of Little Rock, Pulaski County, Arkansas (as recorded in Book E, Page 299, of the Pulaski County Records) and Boydston Subdivision, to the City of Little Rock, Pulaski County, Arkansas (as recorded in Book 1258, Page 131, of the Pulaski County Records): Less and Except a part of Lots 2 and 3 of the Boydston Subdivision to the City of Little Rock, Pulaski County, Arkansas, more particularly described as follows: Starting at the Northwest corner of Lot 3 of Boydston Subdivision; thence South 11 °44'24" West along the West line of thereof a distance of 242.23 feet to a point on the Northerly proposed Right -of -way line of State Highway 10 for the point of beginning; thence south 80 °38'33" East along said proposed right -of -way line a distance of 19.08 feet to a point; thence South 87 °00'57" East along said proposed Right -of -way line a distance of 76.05 feet to a point; thence South 65'38'14" East along said proposed right -of -way line a distance of 25.46 feet to a point on the East line of Lot 3; thence South 00 °30'43" West along said East line a distance of 27.08 feet to a point on the northeasterly existing right -of -way line of State Highway 10; thence North 72 °55'00" West along said existing Right -of -way line a distance of 181.50 feet to a point; thence in a Northwesterly direction along said existing right -of -way line on a curve to the left having a radius of 1949.86 feet a distance of 3.83 feet to a point on the northerly proposed right -of -way line of State Highway 10; thence South 80 °38'33" East along said proposed right -of -way line a distance of 60.23 feet to the Point of Beginning and containing 2,685 square feet, more or less. AND A part of the Fractional NW 1/4, NW 1/4, Section 19, Township 2 North, Range 13 West, Pulaski County, Arkansas, described as follows: Commencing at a found 5/8" rebar at the Northeast corner of said Frl. NW I/4, NW '/4, Section 19, thence N88 °27'51" W a distance of 22.89 feet (deeded west 23') to the point of beginning; thence SO1 °28 "16" W a distance of 376.24' to the North right - of -way line of State Highway 10; thence along said right -of -way N70 049'34 "W a distance of 201.19 feet; thence leaving said right -of -way NO 1'36'54" E a distance of 320.35 feet; thence S86 °56'32" E a distance of 190.93 feet to the point of beginning, containing 1.530 acres more or less. SECTION 2. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 3. That the change in zoning classification contemplated for Magnolia Terrace Revised Short-form POD, (Z- 5718 -A), located at 15100 and 15104 Cantrell Road is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 4. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 5. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
