AN ORDINANCE RECLASSIFYING PROPERTY
LOCATED IN THE CITY OF LITTLE ROCK,
ARKANSAS, AMENDING THE OFFICIAL ZONING
MAP OF THE CITY OF LITTLE ROCK, ARKANSAS;
AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the zone classification of the following property be and is
hereby changed as indicated:
Z- 6554 -C — Described as Part of the S 1/2 of the SW '/4 of Section 4, T -1 -N,
R -13 -W, Little Rock, Pulaski County, Arkansas including part of Tracts
12 and 13 of the Montclair Subdivision, Pulaski County, Arkansas more
particularly described as: Commencing at the southeast corner of Tract
15, said Montclair Subdivision; thence NO2 °33' 16 "E, 15.0 feet; thence
S87 045'01 "E along the north right -of -way line of Kanis Road, being 45.00
feet for the centerline thereof, 201.58 feet to the point of beginning; thence
NO2 015'59 "E, 311.22 feet; thence S87 017'59 "E, 380.58 feet to a point on
the west right -of -way line of Bowman Road; thence southerly along said
west right -of -way line, the following: (1) S02 °39'45 "W, 52.23 feet; (2)
S07 048'46 "W, 111.39 feet; (3) S02 °39'45 "W, 125.29 feet; and (4)
southwesterly along the arc of a 20.00 foot radius curve to the right, a
chord bearing and distance of S17 °27 "22 "W, 28.18 feet to a point on the
said north right -of -way line of Kanis Road; thence N87 045'01 "W along
said north right -of -way line, 348.50 feet to the point of beginning
containing 2.6502 acres more or less (located on the Northwest corner of
Kanis Road and South Bowman Road); from C -3 with Conditions to C -3
with Conditions.
SECTION 2. That the C -3 zoning of the property described above in Section 1 of
this ordinance shall be subject to the following conditions (proposed by the applicant)
which shall be covenants running with the land to bind subsequent grantees of the
property.
A. There is to be a no building constructed in the 90 -feet by 200 -feet area
directly at the southeast corner of the property as represented on the
attached illustration (Attachment A).
B. The permitted uses of the property shall only be those listed in the "C -2"
Shopping Center District.
C. Attachment "A" is not a site plan and is only an illustration for the purpose
of identifying the conditions outlined in Section 2 -A of this ordinance.
SECTION 3. That the map referred to in Chapter 36 of the Code of Ordinances
of the City of Little Rock and designated district map be and is hereby amended to the
extent and in the respects necessary to affect and designate the change provided for in
Section 1 hereof.
SECTION 4. That the Ordinance shall take effect and be in full force 30 days
after the date of its passage and approval.
SECTION 5. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
SECTION 6. Repealer. All laws, ordinances, resolutions, or parts of the same,
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.
