ORDINANCE OF THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS, VACATING AND
CLOSING PARTS OF ROCK AND 30TH STREETS BOR-
DERING AND WITHIN THE MARY ANN AND QUAPAW
ADDITIONS TO THE CITY OF LITTLE ROCK, ARKANSAS.
WHEREAS, a petition was duly filed with the Board of Directors
of the City of Little Rock, Arkansas, on the 10th day of April
1978, asking the Board of Directors to vacate and abandon parts of
the streets in the Mary Ann Addition to the City of Little Rock, as
designated on the plat of said Addition now appearing of record in
Plat Book 1, Page 75, in the office of the Recorder of Pulaski
County, Arkansas, subject, however, to any public easements in
said streets; and
WHEREAS, after due notices as required by law, the Board of
Directors has, at the time and place mentioned in the notice,
heard all persons desiring to be heard on the question and has
ascertained that the streets, hereinbefore described, have here-
tofore been dedicated to the public use as streets, as herein
described; has not been actually used by the public generally
for a period of at least five (5) years subsequent to the filing
of the plat; that all of the owners of the property abutting
upon the streets to be vacated have filed with the Board of
Directors their written consent to such abandonment; and that
public interest and welfare will not be adversely affected by
the abandonment of such streets;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, hereby releases,
vacates and abandons all its rights, together with the rights of
the public generally, in and to the streets designated as follows:
That part of 30th Street (formerly 29th Street)
beginning in the west at a line between the
northwest corner of the East Half of Lot 31 of
the Mary Ann Addition as recorded in Plat Book 1
at Page 75 and the southwest corner of Lot 8 of
the Mary Ann Addition as recorded in Plat Book 1
at Page 75 and continuing to Rock Street; and
That part of Rock Street bordering Lot 38 of the
Mary Ann Addition as recorded in Plat Book 1 at
Page 75, 30th Street (formerly 29th Street), and
Part of Lot 1 of the Mary Ann Addition as recorded
in Plat Book 1 at Page 75.
subject, however, to any public utility and storm drainage
easements located in said streets.
SECTION 2. A copy of this Ordinance, duly certified
by the City Clerk, shall be filed in the office of the Recorder
of Pulaski County and recorded in the Deed Records of the County.
SECTION 3. This Ordinance shall take effect and be in
force from and after its passage.
