15268 1 RESOLUTION NO. 15,268 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO AN ANNUAL AGREEMENT WITH JEDIDIAH SAWYER TREE 5 SERVICE AS PRIMARY CONTRACTOR, AND THE TREE MARSHALL 6 AS SECONDARY CONTRACTOR,FOR THE PURPOSE OF PROVIDING 7 TREE REMOVAL AND TREE TRIMMING SERVICES ON AN AS- 8 NEEDED BASIS FOR VARIOUS CITY DEPARTMENTS; AND FOR 9 OTHER PURPOSES. 10 11 WHEREAS, an invitation to bid on an annual agreement, under Bid No. 896, was issued to provide 12 annual Tree Removal and Tree Trimming Services on an as-needed basis for various City Departments; 13 and,Jedidiah Sawyer Tree Service provided the lowest qualified bid meeting specifications;and,The Tree 14 Marshall, submitted the second lowest qualified bid meeting specifications; and, the bid allows for a one 15 (1)-year agreement,with two(2)additional, mutually agreed upon one(1)-year extensions; and, 16 WHEREAS, this resolution authorizes the City Manager to enter into an agreement with Jedidiah 17 Sawyer Tree Service as primary contractor, and The Tree Marshall, as secondary contractor, having 18 submitted the two(2) lowest bids to provide annual Tree Removal and Tree Trimming Services on an as- 19 needed basis for various City Departments. 20 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 21 OF LITTLE ROCK,ARKANSAS: 22 Section 1. The Board of Directors hereby authorize the City Manager to enter into an agreement 23 through Bid No. 896 with Jedidiah Sawyer Tree Service,as primary contractor;and,The Tree Marshall as 24 secondary contractor. 25 Section 2. Funds for this purchase are available in the Operating Budgets of the various City 26 Departments desiring the use of these contract services. 27 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 28 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 29 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 30 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 31 resolution. 32 Section 4. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this 33 resolution are hereby repealed to the extent of such inconsistency.
