3 A RESOLUTION TO AUTHORIZE THE MAYOR AND CITY CLERK TO
4 EXECUTE ANY DOCUMENTS NECESSARY TO ACCEPT A
5 QUITCLAIM DEED FROM THE LITTLE ROCK WATER
6 RECLAMATION AUTHORITY; AND FOR OTHER PURPOSES.

8 WHEREAS,the Little Rock Water Reclamation(hereinafter"LRWRA")does not generally hold title
9 to real property in its name, and instead, real property is typically owned by the City of Little Rock,
10 Arkansas,for the use and benefit of the LRWRA; and,
11 WHEREAS, LRWRA determined that it is the record owner of the following described property
12 situated in Pulaski County,Arkansas(hereinafter the"Property"):

15 WHEREAS,the Property is subject to easements, rights of way, and protective covenants of record,
16 including,the LRWRA permanent easement described as follows:
17 Commencing at the NE corner of said NW 1/4, Section 22, T-1-N, R-12-W, thence along
18 the northern line of said NW 1/4 N 86°48'19"W 29.98 feet to the western right-of-way line of
19 Arch Street; thence along said western right-of-way line S 03°09'31" W 347.75 feet to the
20 southeastern property corner of Pump Station No. 2; thence along the southern property
21 line of said Pump Station S73°49'56"W 159.95 feet to the southwestern property corner of
22 said Pump Station;thence along the western property line of said Pump Station N16°10'10"
23 W 50.02 feet to the Point of Beginning, said point being the center line of said fifty (50)-
24 foot easement; thence along the centerline of said fifty (50)-foot easement the following
25 courses: S 73°51'16"W 273.32 feet;N 72°54'41"W 369.34 feet and S 55°18'48"W 563.04
26 feet to the southern property line of the City of Little Rock tract. The side lines of said
27 strip of easement are to be lengthened or shortened to terminate in the western boundary
28 line of the Pump Station No. 2 tract and the southern boundary line of the City of Little
29 Rock tract. The above described easement contains 1.38 acres(60,285 square-feet),more
30 or less.
31 WHEREAS,it is the purpose of this resolution to authorize the conveyance of the Property to the City
32 of Little Rock,and for LRWRA to retain its current sewer easement; and,
33 WHEREAS, pursuant to Ark. Code Ann. § 14-54-302 (West/Supp. 2019) a resolution is necessary
34 to accomplish such a transfer of municipal property;

1 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
2 OF LITTLE ROCK,ARKANSAS:
3 Section 1. The Mayor and City Clerk are hereby authorized to execute any necessary documents, in
4 a form acceptable to the City Attorney,to accept the donation of the Property, and to provide for LRWRA
5 to retain its Permanent Sewer Easement.
6 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
7 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
8 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
9 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
10 resolution.
11 Section 3. Repealer. All laws,ordinances, resolutions, or parts of the same,that are inconsistent with
12 the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
