3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH D&J RED IRON AND AGGREGATES,LTD.,
5 IN AN AMOUNT NOT TO EXCEED FOUR HUNDRED FORTY-EIGHT
6 THOUSAND, SIXTY-NINE AND 37/100 DOLLARS ($448,069.37), FOR
7 THE DR. MARTIN LUTHER KING, JR., DRIVE DRAINAGE
8 IMPROVEMENT PROJECT; AND FOR OTHER PURPOSES

10 WHEREAS, bids were solicited for the Dr. Martin Luther King, Jr., Drive Drain Improvements,
11 Project No. 1-17-DR-53, Bid No. 899; and,
12 WHEREAS,D&J Red Iron and Aggregates,Ltd.,was the lowest responsive,responsible bid meeting
13 specifications.
14 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
15 OF LITTLE ROCK,ARKANSAS:
16 Section 1. The City Manager is hereby authorized to execute an agreement with D&J Red Iron and
17 Aggregates, Ltd., for the Dr. Martin Luther King, Jr., Drive Drainage Improvement Project, in an amount
18 not to exceed Four Hundred Forty-Eight Thousand, Sixty-Nine and 37/100 Dollars ($448,069.37), which
19 is the base bid amount of Three Hundred Seventy-Three Thousand,Three Hundred Ninety-One and 14/100
20 Dollars($373,391.14), plus 20%contingencies.
21 Section 2. Funding for this project is from the%-Cent Capital Improvement Sales and Compensating
22 Use Tax Funds and the Capital Improvement Bonds as authorized by Resolution No. 14,803.
23 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
24 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
25 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
26 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
27 resolution.
28 Section 4. Repealer.All laws, ordinances,resolutions,or parts of the same,that are inconsistent with
29 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
