3 A RESOLUTION TO AUTHORIZE THE MAYOR, CITY MANAGER
4 AND CITY CLERK TO ENTER INTO A TRANSFER AGREEMENT FOR
5 OWNERSHIP OF RIGHT-OF-WAY FROM THE CITY OF LITTLE
6 ROCK, ARKANSAS, TO THE ARKANSAS DEPARTMENT OF
7 TRANSPORTATION; AND FOR OTHER PURPOSES.

9 WHEREAS, the Arkansas Department of Transportation (ArDOT) has reviewed ownership of the
10 right-of-way for the widening and reconstruction of Interstate 30 and Interstate 40 from Interstate 530 to
11 Highway 67 and determined that the City of Little Rock owns the right-of-way of Tracts 20, 20E-1,20E-
12 2,22,26,26E-1,26E-2, 26E-3,29E-1 as identified in Job No. CA0602; and,
13 WHEREAS, it is desirable that the City of Little Rock would transfer the ownership of this right-of-
14 way property to ArDOT for this important transportation improvement project.
15 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
16 OF LITTLE ROCK,ARKANSAS:
17 Section 1. The Mayor, City Manager and City Clerk are hereby authorized to execute, in a form
18 approved by the City Attorney, any sales contracts and documents required to donate and convey to
19 ArDOT, the public right-of-way and land located in Pulaski County, Arkansas, described as Tracts 20,
20 20E1,20E2,22,26,26E-1, 26E-2, 26E-3,29E-1 on the right-of-way maps of ArDOT Job No. CA0602.
21 Section 2. Upon passing and receipt of this resolution,the Arkansas State Highway Commission will
22 commence the transfer process of the right-of-way from the City of Little Rock.
23 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
24 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
25 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
26 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
27 resolution.
28 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
29 with the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
