21864 1 ORDINANCE NO. 21,864 2 3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE 4 TO BID; TO AUTHORIZE THE CITY MANAGER TO ENTER INTO A 5 SOLE-SOURCE CONTRACT WITH ULTRA ELECTRONICS/FORENSIC 6 TECHNOLOGY,IN THE AMOUNT OF TWO HUNDRED NINETY-FOUR 7 THOUSAND, TWO HUNDRED SIXTY-EIGHT AND 39/100 DOLLARS 8 ($294,268.39), FOR THE PURCHASE OF A NATIONAL INTEGRATED 9 BALLISTIC INFORMATION NETWORK (NIBIN) SYSTEM FOR THE 10 LITTLE ROCK POLICE DEPARTMENT; AND FOR OTHER PURPOSES. 11 12 WHEREAS,the Little Rock Police Department(LRPD)has a need for the National Integrated Ballistic 13 Information Network(NIBIN) System that will enable LRPD's Crime Gun Intelligence to supply missing 14 elements and to have an effective Crime Gun Intelligent Center (CGIC) based upon the Department of 15 Justice's Best Practices;and, 16 WHEREAS, NIBIN is a multidisciplinary collaborative effort focused on the timely collection, 17 management and analysis of crime gun evidence in order to proactively identify shooters;and, 18 WHEREAS, LRPD partners with Alcohol Tobacco and Firearms (ATF), the State Prosecuting 19 Attorney, the U.S. Attorney, the University of Arkansas at Little Rock, surrounding Law Enforcement 20 Agencies and others,NIBIN is the only Interstate Automated Ballistic Imaging Network in operation in the 21 United States and will enable LRPD to have 24/7 access to the system; and, 22 WHEREAS,LRPD obtained permission from ATF to join the network and Ultra Electronics/Forensic 23 Technology is the only vendor that makes this system; and, 24 WHEREAS,the total cost of the NIBIN System is Two Hundred Ninety-Four Thousand,Two Hundred 25 Sixty-Eight and 39/100 Dollars($294,268.39),which includes a three(3)-year warranty,delivery, installa- 26 tion, instruction and use tax. 27 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 28 OF LITTLE ROCK,ARKANSAS: 29 Section 1. The City Manager is authorized to execute an agreement with the sole vendor, Ultra 30 Electronics/Forensic Technology for the purchase of the National Integrated Ballistic Information Network 31 (NIBIN) System for an amount not to exceed Two Hundred Ninety-Four Thousand, Two Hundred Sixty- 32 Eight and 39/100 Dollars ($294,268.39), which includes a three (3)-year warranty, delivery, installation, 33 and instruction and use tax. A total of 100%of the funds for this purchase are provided through the Crime Gun Intelli- 2 gence Center Grant, from the United States Department of Justice, Account No. 270529-G35167. 3 Section 3. Because Ultra Electronic/Forensic Technology is the only vendor to make the system, it is 4 determined to be impractical and unfeasible to submit this purchase to a competitive bid process. 5 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 6 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 7 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 8 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 9 ordinance. 10 Section 5. Repealer.
