3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., 19,233
4 (NOVEMBER 9, 2004) TO CLARIFY THE LANGUAGE IN SECTION
5 THREE OF THE ORDINANCE IN CONNECTION WITH THE
6 NUMBERING OF THE BUILDINGS; TO DECLARE AN EMERGENCY;
7 AND FOR OTHER PURPOSES.

9 WHEREAS, the Board determined in Section 3 of Little Rock, Ark., Ordinance
10 No. 19,233 (November 9, 2004) to, among other things, require that no grading permit
11 would be issued for "Lot 1" until a building permit for all the buildings located on "Lot
12 1" is permitted for construction, and
13 WHEREAS, the language used in Section 3 of the ordinance has since changed
14 pursuant to the project's requirements and negotiations among the parties involved,
15 and
16 WHEREAS, the present language of Section 3 has impacted the ability of the
17 property owner to proceed with properly developing the property,
18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
19 OF LITTLE ROCK, ARKANSAS:
20 Section 1. The last bullet point in Section 3 of Little Rock, Ark., 19,233
21 (November 9, 2004) which states "No grading permit will be issued for Lot 1 until a
22 building permit for all the buildings on Lot 1 is permitted for construction" is hereby
23 repealed and replaced with the following language "No grading permit will be issued
24 for Buildings 100 -900 until a building permit for all of the buildings comprising
25 Buildings 100 -900 is permitted for construction" in light of the fact that the language
26 used in the previous Ordinance has changed to the current language.

To clarify the language regarding the numbering of the buildings
Referred to in Little Rock, Ark., Ordinance No. 19,233 (November 9, 2004)
I Section 2. Severability. In the event any title, section, paragraph, item,
2 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
3 or unconstitutional, such declaration or adjudication shall not affect the remaining
4 portions of the ordinance which shall remain in full force and effect as if the portion so
5 declared or adjudged invalid or unconstitutional was not originally a part of the
6 ordinance.
7 Section 3. Repealer. All ordinances, resolutions, bylaws, and other matters
8 inconsistent with this ordinance, particularly including but not limited to Little Rock,
9 Ark., Ordinance No. 19,233 (November 9, 2004), are hereby repealed to the extent of
10 such inconsistency.
11 Section 4. Emergency. The ability to properly reflect the City's interest in various
12 parcels of property is essential to maintain the public health, safety and welfare, and the
13 clarification of the language regarding the numbering of the buildings on the property involved
14 in this ordinance is also essential; an emergency is, therefore, declared to exist and this ordinance
15 shall be in full force and effect from and after the date of its passage.
