120361 2 RESOLUTION NO. 12,036 3 A RESOLUTION TO AUTHORIZE THE EXECUTION OF A 4 MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF 5 LITTLE ROCK, AND THE CITIES OF NORTH LITTLE ROCK AND 6 CONWAY, AND PULASKI AND FAULKNER COUNTIES, TO 7 COMBINE RESOURCES AND FY 03 PART I STATE HOMELAND 8 SECURITY GRANT PROGRAM FUNDING TO COORDINATE AND 9 PARTICIPATE IN FULL SCALE WMD/TERRORISM EXERCISES TO 10 TEST EQUIPMENT PURCHASED UNDER THE GRANT PROGRAM; 11 AND FOR OTHER PURPOSES. 12 13 WHEREAS, the Cities of Little Rock, North Little Rock, and Conway, and 14 Pulaski County and Faulkner County desire to conduct a coordinated exercise to test 15 equipment purchased with federal grant funds for use in emergency WMD/ terrorism 16 situations; and 17 WHEREAS, the jurisdictions have drafted a Memorandum of Agreement which 18 sets forth the agreement between them; and 19 WHEREAS, a budget for the exercise has been prepared which allocates 20 funding responsibility among jurisdictions, a copy of which is attached; and 21 WHEREAS, funds will be utilized for a contractor to assist in the coordination of 22 the exercise and write the required reports, for overtime pay, and for expendable 23 supplies; and 24 WHEREAS, the work product will be an "After Action Report" for submission 25 to the Arkansas Department of Emergency Management. [PAGE 1 of 21 Resolution lnterlocal Agreement between the City of Little Rock, Arkansas and Conway I NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 2 THE CITY OF LITTLE ROCK, ARKANSAS: 3 Section 1. The Board of Directors hereby authorizes the City Manager to enter 4 into a Memorandum of Agreement with the Cities of North Little Rock and Conway, 5 and Pulaski and Faulkner Counties for a joint full scale, WMD /Terrorism exercise as set 6 forth in the attached Memorandum of Agreement and budget. 7 Section 2. This Memorandum of Agreement is entered into pursuant to Ark. 8 Code Ann. X25- 20- 104(h), and shall expire March 31, 2006. 9 Section 3. Severability. In the event any portion of this resolution is declared or 10 adjudged to be invalid or unconstitutional, such declaration or adjudication shall not 11 affect the remaining portions of this resolution, which shall remain in full force and 12 effect as if the portion so declared or adjudged invalid or unconstitutional was not 13 originally a part of this resolution. 14 Section 4. Repealer. Carpenter, Ci Attorney Resolution Interlocal Agreement between the City of Little Rock, Arkansas and Conway APPROVED: "' ) -�& h 1,9/, - A /9 '?, Barbara Graves, Vice Mayor [PAGE 2 of 2] Memorandum of Agreement Metro HSEEP TALON The following entities: Pulaski County, the City of Little Rock, the City of North Little Rock, the City of Conway and Faulkner County enters into this Memorandum of Agreement as attested below: Purpose. The purpose of this agreement is for the above - listed agencies to combine resources and FY 03 Part I State Homeland Security Grant Program funding to participate in a joint full scale, WMD /Terrorism exercise that will adequately test the equipment purchased under these programs. The City of Little Rock and City of Conway through Faulkner County will also combine FY 02 Homeland Security Grant Program funding in order to exercise and evaluate the explosive ordinance equipment that was purchased under this program. This exercise will meet Office of Domestic Preparedness (ODP) funding requirements and be evaluated in accordance with Homeland Security Exercise Evaluation Program (HSEEP) guidelines. Scope. The scope of this project will be to work with Little Rock as the lead agency to hire a contractor to assist in coordination of the exercise, provide evaluators and complete the necessary After Action Report to submit to the Arkansas Department of Emergency Management (ADEM) for evaluation using HSEEP. Powers. Each agency will follow their respective finance procedures to legally enter into this agreement and commit funding provided by the FY 03 Part I State Homeland Security Grant Program and FY 02 funding in the cases of Little Rock and Faulkner County. Rights. Pulaski County, the City of Little Rock, City of North Little Rock, City of Conway and Faulkner County will be in charge of their equipment and personnel at all times during the execution of this exercise under a Unified Command Incident Management System. Obligations. _ Each agency listed above will participate in this exercise scheduled for September 19, 2005, until their respective objectives have been completed for the purpose of ODP requirements and HSEEP evaluation. Responsibilities. Each agency will attend planning meetings and complete all local procedural and legal requirements for committing their FY 02 State Homeland Security Grant Program funds, if allocated, and FY 03 Part I State Homeland Security Grant Program funds allocated for the purpose of this exercise. Duration. This agreement will remain in effect until the project is completed in full to include that all required information be provided by each agency for the After Action Report in accordance with HSEEP guidelines and payment of contractor hired by the City of Little Rock not to exceed March 31, 2006. Financing. Each jurisdiction has been allocated additional FY 03 Part I State Homeland Security Grant Program funding to assist in meeting the ODP exercise requirements and evaluate using HSEEP guidelines. The City of Little Rock and City of Conway through Faulkner County have been allocated additional FY 02 Homeland Security Grant Program funding to test and evaluate their respective explosive ordinance teams. This project will be financed with the combination of these funds with the provision that each jurisdiction will apply their respective grant funds to meet ODP exercise requirements. Each jurisdiction will be responsible for the overtime of their respective players in the exercise with the understanding that these costs will be reimbursed by the grant funds. In addition, each jurisdiction will contribute to the funding of the contractor to act as a HSEEP evaluator and controller and to pay for expendable supplies. The contractor will be required to invoice each jurisdiction individually for their pro rated share. The level of contribution will be based on a pro rated amount of the funding allocated to each jurisdiction for accomplishing their respective ODP exercise requirements, as outlined in the attached budget. Administration. A request for Proposal will be completed and advertised by the City of Little Rock in accordance with state law, concerning the hiring of a contractor to complete the objectives of coordinating the exercise, meeting ODP guidelines and completion of the After Action Report to meet HSEEP guidelines for each jurisdiction. Each jurisdiction will be responsible for meeting with the contractor to ensure that ODP guidelines are met with respect to their equipment and respective responsibilities and to provide the necessary assistance to complete the After Action Report using HSEEP.
