5 STREET,LOCATED IN THE EAST 1/2,NORTHWEST 1/4,NORTHWEST 1/4,
6 NORTHEAST 1/4,TOWNSHIP-I-NORTH,RANGE-7-WEST,LITTLE ROCK,
7 ARKANSAS; AND FOR OTHER PURPOSES.

9 WHEREAS,the City of Little Rock,Arkansas(the"City")maintains the Van Buren Street right-of-way
10 located between West 13th Street and West 14th Street adjacent to Lots 1 and 12, Block 1, Metropolitan
11 Addition, Plat of record dated April 24, 1906, and recorded in Plat Book No. 1, Page No. 122A and the
12 unrecorded Good Counsel Church property described as the East 1/2,NW 1/4,NW 1/4,NE 1/4, T-1-N,R-7-W,
13 Little Rock,Pulaski County,Arkansas;Pulaski County Assessor's Parcel No. 34L117000200; and,
14 WHEREAS,Our Lady of Good Counsel Catholic Church is requesting the abandonment and proposes to
15 incorporate the abandoned right-of-way into a new parking lot on the west side of the right-of-way; and,
16 WHEREAS, the right-of-way serves no public purpose and pavement within the right-of--way serves
17 primarily as a means of access to the church parking lot located on the east side of the right-of-way;and,
18 WHEREAS,the area of the abandoned right-of-way will be retained as Utility and Drainage Easement.
19 NOW,THEREFORE,BE IT ORDAINDED BY THE BOARD OF DIRECTORS OF THE CITY
20 OF LITTLE ROCK,ARKANSAS:
21 Section 1. The Little Rock Planning Commission first reviewed and conditionally approved a Conditional
22 Use Permit at the December 5, 2019,meeting, and there were no objectors present.
23 Section 2. A public hearing concerning the abandonment of the Van Buren Street right-of-way located
24 between West 13th Street and West 14th Street adjacent to Lots 1 and 12,Block 1,Metropolitan Addition,Plat
25 of record dated April 24, 1906, and recorded in Plat Book No. 1,Page No. 122A and the unrecorded Good
26 Counsel Church property described as the East'h,NW 1/4,NW 1/4,NE 1/4,T-1-N,R-7-W,Little Rock,Pulaski
27 County,Arkansas;Pulaski County Assessor's Parcel No.34L117000200 was held by the Board of Directors at
28 its meeting on the 4th day of February, 2020, at City Hall, 500 West Markham, Little Rock, Arkansas. All
29 interested persons had the opportunity to be heard concerning the abandonment of the easements and
30 covenants.
31 Section 3. Severability. In the event any portion of this ordinance is declared or adjudged to be invalid or
32 unconstitutional, such declaration or adjudication shall not affect the remaining portions of this ordinance,
33 which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional

1 was not originally a part of this ordinance.
2 Section 4. Repealer. All ordinances and resolutions, and parts thereof,which are in conflict with any
3 provision of this ordinance are hereby repealed to the extent of such conflict.
