21785 1 ORDINANCE NO. 21,785 2 3 AN ORDINANCE TO AMEND CHAPTER 32,ARTICLE VI, DIVISION 4 - 4 METERED PARKING, § 32-401 -THROUGH § 32-412, OF THE REVISED 5 CODE OF ORDINANCES (1988) OF THE CITY OF LITTLE ROCK, 6 ARKANSAS; TO DECLARE AN EMERGENCY; AND FOR OTHER 7 PURPOSES. 8 9 WHEREAS, parking technology is expanding through the use of telephones, telephone applications 10 and the Internet; and, 11 WHEREAS, it has been determined that modifications to Chapter 32 of the City Code are necessary 12 in order to address this technology and allow the City's parking customers to pay for on-street parking 13 using technology and emerging payment systems. 14 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 15 OF LITTLE ROCK,ARKANSAS: 16 Section 1. Little Rock,Ark.,Rev. Code § 32-401 is hereby amended to read as follows: 17 Sec.32-401.-Installation of parking meters or parking meter technology. 18 The City Manager or the Manager's designee shall install parking meters upon the curb 19 immediately adjacent to parking spaces or implement parking technology in parking meter 20 zones. Parking meter technology means technology that allows payment for parking in 21 parking meter zones without the use of mechanical parking meters, including, but not limited 22 to telephone, smartphone applications, website, storefront payment, single or multi-space 23 parking meters, or any other technology as deemed appropriate by the city to pay for parking. 24 Parking meter technology may utilize parking space numbers, license plates, sticker numbers, 25 or any other means designated by the specific parking meter technology to process parking 26 payment. 27 Section 2. Little Rock,Ark.,Rev. Code § 32-402 is hereby amended to read as follows: 28 Sec.32-402.—Parking meter spaces and zones. 29 (a) The City Manager or the Manager's designee shall designate the parking space 30 adjacent to each parking meter for which the meter is to be used by appropriate markings 31 upon the curb or the pavement of the street. Parking meter spaces so designated shall be of 32 appropriate length and width so as to be accessible from the traffic lanes of such street. No 33 person shall park a vehicle in any such designated parking meter space during the restricted 34 and regulated time applicable to the parking meter zone in which such meter is located so that [Page 1 of 5] 1 any part of such vehicle occupies more than one (1) space or protrudes beyond the marking 2 designating such spaces except that vehicle which is of a size too large to be parked within a 3 single designated parking meter zone shall be permitted to occupy two (2) adjoining parking 4 meter spaces when payment shall have been deposited in the parking meter for such space or 5 payment for the parking space has been made using parking meter technology. 6 (b) The City Manager or the Manager's designee shall implement parking meter zones 7 through the use of parking meters or parking meter technology. For any parking meter zone 8 or space for which no meter is installed adjacent to the space, signage shall be installed in the 9 area and visible from the space indicating that payment of the parking meter rates for that 10 space,zone, or area shall be made using parking meter technology. 11 Section 3. Little Rock,Ark.,Rev. Code § 32-403 is hereby amended to read as follows: 12 Sec.32-403.—.Deposit of coins and time limits. 13 (a)No person shall park a vehicle in any parking space upon a street alongside of and 14 next to which a parking meter has been installed during the restricted and regulated time 15 applicable to the parking meter zone in which such meter is located unless payment for 16 the parking space has been made using parking meter technology or a coin or coins of the 17 appropriate denomination as provided in this division shall have been deposited therein, 18 or shall have been previously deposited therein for an unexpired interval of time, and the 19 meter has been placed in operation. 20 (b) No person shall permit a vehicle under his control to be parked in any parking 21 meter space during the restricted and regulated time applicable to the parking meter zone 22 in which such meter is located while the parking meter for such space indicates by signal 23 that the lawful parking time in such space is expired. This Subsection does not apply to 24 the act of parking or the necessary time which is required to deposit immediately 25 thereafter a coin in the meter or if payment for parking has been made using parking 26 meter technology. 27 (c) The penalty for violation of this provision shall be Fifteen Dollars ($15.00) for 28 each consecutive period of time the motor vehicle is parked in the space without being 29 moved if the ticket is paid within thirty(30) days of the issuance of a ticket. If the fine is 30 not paid until after thirty (30) days of the issuance of the ticket, then the fine shall be 31 Fifty Dollars ($50.00). A combination ticket and envelope shall be provided at the 32 issuance of a violation citation for the convenience of motorists.The penalty shall be paid 33 by paying the fine to the City. 34 (d) The provisions of this section shall not relieve any person from the duty to observe 35 other provisions of this Chapter. [Page 2 of 5] 1 Section 4. Little Rock,Ark.,Rev. Code § 32-404 (b)is hereby amended to read as follows: 2 Sec.32-404.—Use of slugs prohibited; tampering. 3 (b) No person shall deface, injure, tamper with, open or willfully break, destroy,_or 4 impair the usefulness of any parking meter, parking sign, parking sticker, or parking meter 5 technology. 6 Section 5. Little Rock,Ark.,Rev. Code § 32-405 is hereby amended to read as follows: 7 Sec.32-405.—Limited time zones. 8 The City Manager or the Manager's designee may determine the location of limited time 9 parking-meter zones upon the streets within the jurisdiction of this City and place and maintain 10 appropriate signs and parking meters indicating the same and stating the hours during which the 11 limitations are applicable. The installation of such zones shall be subject to the following 12 conditions: 13 (1) All time limited zones heretofore designated and marked are designated by 14 signage to display the time limit for a parking zone. 15 (2)No person shall park any vehicle in a time limited parking-meter zone for longer 16 than the posted time limit at any time between the hours of 8:00 AM and 6:00 PM on 17 Monday through Saturday except on days and holidays and only upon the minimum 18 deposit of Twenty-Five Cents ($0.25) in the parking meter located alongside such zone 19 or payment for parking using parking meter technology. 20 (3) Notwithstanding any existing ordinance to the contrary, in any parking meter 21 zone which limits the legal parking time, the legal parking time may be extended for 22 additional time using parking meter technology, at an accelerated rate for each additional 23 sixty(60)minutes as determined by the City Manager or Manager's designee. 24 Section 6. Little Rock, Ark., Rev. Code § 32-406, Thirty minute zones, § 32-407, One-hour zones, 25 and § 32-408,Two-hour zones, are hereby deleted in their entirety. 26 Section 7. Little Rock,Ark.,Rev.Code § 32-410(b)is hereby amended to read as follows: 27 Sec.32-410.—Metered parking at the Bill and Hillary Clinton National Airport. 28 (b) The penalty for violation of this provision shall be Fifteen Dollars ($15.00) for each 29 consecutive period of time the motor vehicle is parked in the space without being moved if 30 the ticket is paid within thirty(30)days of the issuance of a ticket. If the fine is not paid until 31 after thirty(30)days of the issuance of the ticket,then the fine shall be Fifty Dollars($50.00). 32 A combination ticket and envelope shall be provided at the issuance of a violation citation for 33 the convenience of motorists. The penalty shall be paid by paying the fine to the city. 34 Section 8. Little Rock,Ark.,Rev. Code § 32-411 (a)is hereby amended to read as follows: 35 [Page 3 of 5] 1 Sec.32-411.—Pay and display zone. 2 (a) No person shall park or permit to be parked any vehicle in a space controlled by a 3 "Pay and Display" Parking Pay Station without properly displaying proof of payment as 4 described in this section or making payment for parking using parking meter technology. For 5 parallel parking on one (1)- and two (2)-way streets, proper display of proof of payment 6 requires affixing the receipt dispensed by the Parking Pay Station inside the vehicle to the 7 front seat's side window nearest the curb in such a manner that the expiration time and date 8 are readily visible from the exterior. For motorcycles, receipts shall be affixed on the 9 headlight cover. No more than one(1)receipt shall be displayed. 10 Section 9. Little Rock,Ark.,Rev. Code § 32-411 (b)is hereby amended to read as follows: 11 Sec.32-411.—Pay and display zone. 12 (b) No person shall stop, stand or permit a vehicle within his control to be parked in any 13 parking space controlled by a "Pay and Display" Parking Pay Station without displaying on 14 the vehicle an unexpired proof of payment receipt issued by a Parking Pay Station or making 15 payment for parking using parking meter technology. 16 Section 10. Little Rock,Ark.,Rev. Code § 32-412 is hereby amended to read as follows: 17 Sec.32-412.—Penalties. 18 The penalty for violation of overtime parking in all metered parking areas in Sections 32-401 through 19 32-411 not specified within a particular section shall be: 20 (a)Fifteen Dollars($15.00)if paid within thirty(30)days of the issuance of the ticket; 21 (b) Fifty Dollars ($50.00) if paid after thirty (30) days of the issuance of the ticket, or 22 after conviction in District Court for violation of City Parking Ordinances. 23 A combination ticket and envelope shall be provided at the issuance of a violation citation for the 24 convenience of motorists.The penalty shall be paid by paying the fine to the City. 25 Section 11. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, 26 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or 27 unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this 28 ordinance,as if such invalid or unconstitutional provision were not originally a part of this ordinance. 29 Section 12. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this 30 ordinance are hereby repealed to the extent of such inconsistency. 31 Section 13. Emergency. The Board of Directors finds that the implementation of parking meter 32 technology improvements with a mobile payment option for parking meters will be a benefit to the City's 33 residents and visitors, and these City Code revisions will allow this parking technology to be implemented 34 as quickly as possible in order to increase the City's ability to effectively regulate on street parking within 35 the various areas of the City; such effective regulation is essential to maintain public health, safe and [Page 4 of 5] 1 welfare of the citizens of Little Rock, therefore an emergency is hereby declared to exist and this 2 ordinance shall be in full force and effect from and after the date this adoption. 3 ' .
