3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH JAMES A.ROGERS EXCAVATING,INC.,IN
5 AN AMOUNT NOT TO EXCEED TWO HUNDRED THIRTY-THREE
6 THOUSAND, FIVE HUNDRED THIRTY-SEVEN AND 63/100 DOLLARS
7 ($233,537.63), FOR THE LANDFILL FLEET SHOP ACCESS DRIVE AND
8 PARKING IMPROVEMENTS; AND FOR OTHER PURPOSES

10 WHEREAS,Bids were solicited for the Landfill Fleet Shop Access Drive & Parking Improvements,
11 Bid No. 751;.and,
12 WHEREAS, James A. Rogers Excavating, Inc., was the lowest responsive, responsible bid meeting
13 specifications.
14 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
15 OF LITTLE ROCK,ARKANSAS:
16 Section 1. The City Manager is hereby authorized to execute an agreement with James A. Rogers
17 Excavating, Inc., for the Landfill Fleet Shop Access Drive & Parking Improvements in an amount not to
18 exceed Two Hundred Thirty-Three Thousand, Five Hundred Thirty-Seven and 63/100 Dollars
19 ($233,537.63),which is the base bid amount of One Hundred Ninety-Four Thousand,Six Hundred Fourteen
20 and 69/100 Dollars($194,614.69)plus 20% contingencies.
21 Section 2. Funding for this project is from Landfill Fleet Services,Account No. 600036-61040.
22 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
23 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
24 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
25 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
26 resolution.
27 Section 4. Repealer.All laws, ordinances,resolutions,or parts of the same,that are inconsistent with
28 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
