3 A RESOLUTION TO AUTHORIZE THE MAYOR AND CITY CLERK TO
4 EXECUTE A RIGHT-OF-WAY EASEMENT FOR PROPERTY LOCATED
5 ALONG THE WEST SIDE ADJACENT TO ZEUBER ROAD, TO BE USED
6 FOR THE CONSTRUCTION OF THE ZEUBER ROAD IMPROVEMENTS;
7 AND FOR OTHER PURPOSES.

9 WHEREAS, Pulaski County, Arkansas, is undertaking a project to improve the west side of Zeuber
10 Road; and,
11 WHEREAS, the Zeuber Road Improvement Project necessitates that Pulaski County, Arkansas,
12 acquire a Right-of-Way Easement entitled ROW No. 6, Project No. 19800101; and,
13 WHEREAS,the City Board of Directors have determined that it is in the best interest of the City to
14 grant the Right-of-Way Easement entitled ROW No.6,Project No. 19800101 to Pulaski County,Arkansas,
15 for the Zeuber Road Improvement Project;and,
16 WHEREAS,before the City can alienate any interest in property,as demonstrated by execution by the
17 Mayor and City Clerk, it is required by Ark. Code Ann. § 14-54-302 that the Board of Directors adopt a
18 resolution to authorize such action.
19 NOW, THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
20 OF LITTLE ROCK,ARKANSAS:
21 Section 1. That the Mayor and City Clerk are hereby authorized to execute, in a form approved by the
22 City Attorney,any sales contracts and documents required to convey to Pulaski County,Arkansas,a Right-
23 of-Way Easement more particularly described as:
24 RIGHT-OF-WAY DEDICATION DESCRIPTION: PART OF THE SE 1/4 OF
25 SECTION 20, T-1-N, R-11-W, PULASKI COUNTY, ARKANSAS, BEING MORE
26 PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE SE
27 CORNER OF SAID SECTION 20; THENCE N 0l°59'53" E A DISTANCE OF
28 766.31 FEET; THENCE N 88°46'41" W A DISTANCE OF 1795.70 FEET;THENCE
29 N 01°39'39" W A DISTANCE OF 1,246.69 FEET TO TI IE POINT OF BEGINNING;
30 THENCE N 01°39'39" W A DISTANCE OF 20.31 FEET; THENCE S 83°16'32" E A

7 Section 2. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph,
8 item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or
9 unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this
10 resolution, as if such invalid or unconstitutional provision was not originally a part of this resolution.
11 Section 3. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this
12 resolution are hereby repealed to the extent of such inconsistency.
