15168 1 RESOLUTION NO. 15,168 2 3 A RESOLUTION TO AUTHORIZE THE MAYOR AND CITY CLERK TO 4 EXECUTE A RIGHT-OF-WAY EASEMENT AND A TEMPORARY 5 CONSTRUCTION EASEMENT FOR PROPERTY LOCATED ALONG 6 THE WEST SIDE ADJACENT TO ZEUBER ROAD, TO BE USED FOR 7 THE CONSTRUCTION OF THE ZEUBER ROAD IMPROVEMENTS; 8 AND FOR OTHER PURPOSES. 9 10 WHEREAS, Pulaski County, Arkansas, is undertaking a project to improve the west side of Zeuber 11 Road; and, 12 WHEREAS, the Zeuber Road Improvement Project necessitates that Pulaski County, Arkansas, 13 acquire a Right-of-Way-Easement and a Temporary Construction Easement entitled ROW & TCE No. 4, 14 Project No. 19800101;and, 15 WHEREAS, the City Board of Directors have determined that it is in the best interest of the City to 16 grant the Right-of-Way Easement and the Temporary Construction Easement entitled ROW&TCE No.4, 17 Project No. 19800101 to Pulaski County, Arkansas, for the Zeuber Road Improvement Project; and, 18 WHEREAS,before the City can alienate any interest in property,as demonstrated by execution by the 19 Mayor and City Clerk, it is required by Ark. Code Ann. § 14-54-302 that the Board of Directors adopt a 20 resolution to authorize such action. 21 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 22 OF LITTLE ROCK,ARKANSAS: 23 Section 1. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, 32 item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or 33 unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this 34 resolution,as if such invalid or unconstitutional provision was not originally a part of this resolution.
