Members Present: Chair Ted Holder Vice Chair Jeremiah Russell Lauren Frederick Amber Jones Robert Hodge Members Absent: Dale Pekar Frances McSwain City Attorney: Sherri Latimer Staff Present: Brian Minyard Citizens Present: Greg Smith Sara Urizar Cleveland Thomas Patricia Blick Cindy Pruitt Wendell Kinzler Patricia Blick Laine Harber Stephan McAteer Walter Malone Page Wilson Approval of Minutes Vice Chair Jeremiah Russell made a motion to approve the July 8, 2019 minutes as revised. Commissioner Robert Hodge seconded and the motion passed with a vote of 5 ayes, 0 noes, and 2 absent (Pekar and McSwain). Chair Ted Holder explained that the Commission will lose a quorum and will not be able to hear the Arts Center item today. With only five commissioners present and two recusing form the Arkansas Arts Center item; there will be only three members present which does not constitute a quorum. There was a motion by Vice Chair Jeremiah Russell to amend the order of the agenda to move the Arkansas Arts Center item to be heard before the deferred items in an effort to not make the AAC applicants sit through the demolition deferred items which were deferred from last month. That motion was seconded by Commissioner Robert Hodge and passed with a vote of 5 ayes, 0 noes, and 2 absent (Pekar and McSwain). It was noted that there was confirmation that Commissioner McSwain can attend a meeting at Page 2 of 3 2:00 tomorrow August 13, 2019. There was a discussion on the bylaws on adjoining on a day to day basis as stated in page 4 of the bylaws Article IV C. There was a motion was made by Vice Chair Jeremiah Russell to move the Arkansas Arts center item back to the end of the agenda after item VII Other Matters and seconded by Commissioner Robert Hodge and the motion passed with a vote of 5 ayes, 0 noes, and 2 absent (Pekar and McSwain). Chair Ted Holder apologized for not having a quorum today. Mr. Minyard told the applicants where the meeting would be held tomorrow. It was noted that there were no national register listings to hear today. The next item was the deferred certificates of appropriateness. Mr. Minyard stated that he spoke to Ed Garland and Rick Purifoy, Department of Housing and Neighborhood Programs, today about them attending the meeting. Chair Holder stated that the item cannot be heard since the applicant is not be present. Cleveland Thomas, the owner of 1419 Commerce Street, will meet with Housing and Neighborhood Programs tomorrow at 10:00 to discuss him getting a building permit. Mr. Thomas stated that he could attend a meeting at 2:00 tomorrow. A discussion was held on the validity of adjourning on a day by day basis to conduct business. Sherri Latimer stated that the commission may want to take the issue of citizens scheduling to participate in the meeting tomorrow under advisement. A discussion of the appropriate bylaws was held. Staff noted that they will contact the press, post on the website, and send to the email distribution list to comply with the Arkansas Freedom of Information Act. Vice Chair Jeremiah Russell motioned to defer items A and B (Deferred Certificates of Appropriateness) until after Section VII of the agenda. That motion was seconded by Commissioner Rob Hodge and passed with a vote of 5 ayes, 0 noes, and 2 absent (Pekar and McSwain). Staff Brian Minyard made a presentation on the Other Items in the agenda. Other Matters Enforcement issues Staff had none to report to the Commission. Certificates of Compliance A spreadsheet was distributed to the Commission earlier. Guidelines Revision Committee A meeting was held last Thursday to discuss scope of the work and whether or not a grant should be sought for the pattern book section. Handouts from the meeting will be available to those that were not in attendance. Citizen Communication There were no citizens that chose to speak during citizen communication. Page 3 of 3 Adjournment The meeting was adjourned at 5: 13 until August 13, 2019 at 2:00 pm.
