21791 1 ORDINANCE NO. 21,791 2 3 AN ORDINANCE TO AMEND LITTLE ROCK, ARKANSAS, 4 ORDINANCE NO. 21,749 (JUNE 18, 2019) TO REMOVE A RESIDENTAL 5 PROPERTY FROM THE LIST TO CONDEMN CERTAIN STRUCTURES 6 IN THE CITY OF LITTLE ROCK, ARKANSAS, AS STRUCTURAL, FIRE 7 AND HEALTH HAZARDS; TO PROVIDE FOR SUMMARY 8 ABATEMENT PROCEDURES; TO DIRECT CITY STAFF TO TAKE 9 SUCH ACTION AS IS NECESSARY TO RAZE AND REMOVE SAID 10 STRUCTURES; TO DECLARE AN EMERGENCY; AND FOR OTHER 11 PURPOSES. 12 13 WHEREAS, certain structures in the City of Little Rock, Arkansas, identified in Ordinance No. 14 21,749 (June 18, 2019) had become run-down, dilapidated, unsightly, dangerous, obnoxious and 15 detrimental to the public welfare of the citizens of Little Rock; and, 16 WHEREAS, the residential structure located at 7911 Woodhaven Drive has been sold and the new 17 owner approved to apply for a permit; and, 18 WHEREAS, the estimated cost to demolish and remove the structure was Four Thousand, Eight 19 Hundred Dollars($4,800.00)that will not be charged to the Demolition Account; and, 20 WHEREAS,all notices have been mailed in accordance with Arkansas State Law. 21 NOW,THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 22 OF LITTLE ROCK,ARKANSAS: 23 Section 1. The City of Little Rock, Arkansas, Ordinance No. 21,749 (June 28, 2019) is hereby 24 amended to remove the following property from the list of condemned structures shown in Section 2 25 below. 26 1. 7911 Woodhaven Drive 27 Owner: Gerry Hall 28 Legal: Lot: 22 Block: 0 Woodhaven Addn. 29 Parcel No: 45L0340002300 30 Section 2. The conditions of the remaining structures located on the properties described below have 31 been found to present structural, fire and health hazards and are dangerous to the health and safety of the 32 occupants or other persons, and further, the structures are in such condition as to be dangerous to the 33 lives, limbs and property of people in the vicinity or those lawfully passing thereby. The Board of 34 Directors hereby condemns the following structures, identified by street address, owner, legal description 35 and parcel number, and declares them to be public nuisances: 'Page 1 of 2l d 1 1. 2313 Center Street 2 Owner: Jordan, Inc. 3 Legal: Fulton South, Block 28, Bal of 1 &N 10"of Lot 2 4 Parcel No: 334L2090002400 5 6 2. Dr. Martin Luther King,Jr.,Drive 7 Owner: Michael M. Clay 8 Legal: Lot 8 Block: 15 Braddocks Blvd Ll 9 Parcel No: 34L2750107100 10 Section 3. The City Manager is hereby authorized to direct the Housing & Neighborhood Programs 11 Department to raze and remove the structures condemned in this ordinance and to file and enforce a lien 12 against the properties described herein for the cost of razing and removing said structures pursuant to 13 Little Rock, Ark., Rev. Code ("LRC") §20-29 (1988). 14 Section 4. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, 15 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or 16 unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this 17 ordinance,as if such invalid or unconstitutional provision was not originally a part of this ordinance. 18 Section 5. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this 19 ordinance are hereby repealed to the extent of such inconsistency. 20 Section 6. Emergency Clause.
