15047 1 RESOLUTION NO. 15,047 2 3 A RESOLUTION TO EXPRESS THE WILLINGNESS OF THE CITY OF 4 LITTLE ROCK, ARKANSAS, TO UTILIZE ARKANSAS DEPARTMENT 5 OF PARKS, HERITAGE AND TOURISM OUTDOOR RECREATION 6 GRANT PROGRAM FUNDS; TO AUTHORIZE THE MAYOR AND CITY 7 MANAGER TO EXECUTE ANY AND ALL NECESSARY 8 APPLICATIONS, AGREEMENTS AND CONTRACTS FOR ITS 9 ADMINISTRATION; AND FOR OTHER PURPOSES. 10 11 WHEREAS, the City of Little Rock, Arkansas, ("City") acknowledges that 2019 Grant Funds are 12 available from the Arkansas Department of Parks, Heritage and Tourism's Outdoor Recreation Grants 13 Program; and, 14 WHEREAS,the City further acknowledges that funds are available for this grant project on a"dollar- 15 for-dollar"match basis, and that the City shall provide One Hundred Thousand Dollars($100,000.00)with 16 an additional match of One Hundred Fifty Thousand Dollars ($150,000.00) to be donated by the Junior 17 Deputy Baseball Organization; and, 18 WHEREAS, the grant project will renovate playgrounds and related amenities in two (2) parks, 19 Birchwood and Wakefield and construct a new ball field at Junior Deputy Park with the addition of 20 American Disability Act compliance items; and, 21 WHEREAS, matching funds in the amount One Hundred Thousand Dollars($100,000.00)will come 22 from the Parks portion of the 3/a-Cent Capital Improvement Sales and Compensating Use Tax Funds, 23 Account No. 326459-TS45A11, with the remaining One Hundred Fifty Thousand Dollars ($150,000.00) 24 matching funds to be donated by the Junior Deputy Baseball Organization; and, 25 WHEREAS,the City held four(4)public hearings in May and June 2019,with three(3)of the meetings 26 held to gather input from groups, including seniors and minorities to select participating parks for 27 renovation,the projects are located in Wards 2, 3, and 6; and, 28 WHEREAS,the facilities can be reserved for special events,e.g.,a multi-day music festival,but cannot 29 be reserved, leased or assigned for any exclusive use; and, 30 WHEREAS, if the grant is awarded, the City will be required (via an easement) to permanently 31 maintain the parks and if any park is ever abandoned or moved to another location, then the City will be 32 responsible for the costs of establishing a similar park; and all present and future overhead utility lines 33 within the project boundary must be routed away or placed underground; the project areas must remain (Page 1 0121 1 open and available for use by public at all reasonable times of the day and year. 2 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 3 OF LITTLE ROCK,ARKANSAS: 4 Section 1. The Board of Directors of the City of Little Rock states its desire participate in the use of 5 grant funding in accordance with its designated responsibility, including maintenance of this project. 6 Section 2. The Mayor and City Manager and any other necessary City Employees are hereby authorized 7 and directed to execute any and all appropriate applications,agreements and contracts necessary to expedite 8 the construction and renovation of the above stated project. 9 Section 3. The Board of Directors authorize the City Manager to apply for, and the Arkansas 10 Department of Parks, Heritage and Tourism to initiate action to implement this project. 11 Section 4. Funding for the match portion in the amount One Hundred Thousand Dollars($100,000.00) 12 will come from the Parks Capital Account No. 326459-TS45A11, with the remaining One Hundred Fifty 13 Thousand Dollars($150,000.00)matching funds to be donated by the Junior Deputy Baseball Organization. 14 Section 5. Severability. In the event any title, subtitle, section, subsection, subdivision, paragraph, 15 subparagraph, item,sentence,clause,phrase,or work of this resolution is declared or adjudged to be invalid 16 or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution 17 which shall remain in full force and effect as if the portion so declared or adjudged invalid or 18 unconstitutional was not originally a part of this resolution. 19 Section 6. Repealer.
