2 A RESOLUTION TO SET JULY 12, 2005, AS THE DATE FOR A
3 PUBLIC HEARING ON WHETHER TO ESTABLISH PROMENADE
4 PROPERTY OWNERS MULTI - PURPOSE IMPROVEMENT DISTRICT
5 NO. 1 OF THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR
6 OTHER PURPOSES.
7 WHEREAS, property owners who claim to be all of the owners of record title of
8 real property located within a proposed municipal property owners improvement
9 district as described in Exhibit A, and
10 WHEREAS, a public hearing must be held prior to the creation of this district,
11 which is to be known as Promenade Municipal Property Owners Multi- Purpose
12 Improvement District No. 1 of the City of Little Rock, Arkansas.
13 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
14 THE CITY OF LITTLE ROCK, ARKANSAS:
15 Section 1. The Board of Directors shall conduct a public hearing at 6:00 PM in
16 the Board Meeting Room on the second floor of City Hall at 500 West Markham, Little
17 Rock, Arkansas, on Tuesday, July 12, 2005, on the question of whether to approve the
18 creation of Promenade Municipal Property Owners Multi- Purpose Improvement
19 District No. 1 of the City of Little Rock, Arkansas; all persons wishing to be heard on
20 this issue will be heard at that time.
21 Section 2. The basic description of the boundaries for the proposed District are
22 attached as Exhibit A to this resolution, and the basic list of improvements is attached as
23 Exhibit B.
24 Section 3. Severability. In the event any title, section, paragraph, item, sentence,
25 clause, phrase, or word of this resolution is declared or adjudged to be invalid or
26 unconstitutional, such declaration or adjudication shall not affect the remaining

1 portions of the resolution which shall remain in full force and effect as if the portion so
2 declared or adjudged invalid or unconstitutional was not originally a part of the
3 resolution.
4 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that
5 are inconsistent with the provisions of this resolution are hereby repealed to the extent
6 of such inconsistency.

5 Financing the cost of constructing public improvements including (i) constructing such street
6 and road improvements as may be depicted in the map attached hereto; and to open, grade,
7 drain, pave, curb, gutter or otherwise improve such other streets, roads, highways, and every
8 other way for passage and use of vehicles, and including sidewalks, pedestrian trails and
9 walkways, viaducts, underpasses and appurtenant lighting, within the boundaries of the district if
10 the property of the district will be benefited thereby, and such purposes shall include the
11 acquisition of rights of way; (ii) constructing water mains along various streets and roadways and
12 additional water mains at other locations within the District as may be depicted on the map
13 attached as hereto and other appurtenant water improvements within the boundaries of the
14 District if the property of the District will be benefited thereby; (iii) constructing sanitary sewer
15 mains and storm sewers as may be depicted on the map attached as hereto and other appurtenant
16 sewer improvements within the boundaries of the District if the property of the District will be
17 benefited thereby; (iv) acquiring and constructing electric junction boxes, electric conduits,
18 underground power lines, street lighting and other electric utility improvements as may be
19 depicted on the map attached hereto within the boundaries of the District if the property of the
20 District will be benefited thereby; (v) all other purposes authorized by Ark. Code Ann. Title 14,
21 Chapter 94 and amendments thereto; and (vi) paying the costs associated with such
22 improvements including, but not limited to, engineering, legal, environmental surveys,
23 governmental approvals and permits; and (vii) conducting any and all other acts which shall be
24 deemed necessary in order to purchase, construct, accept as a gift, operate and maintain any and
25 all improvements authorized therein.
