21732 1 ORDINANCE NO.21,732 2 3 AN ORDINANCE TO AMEND CHAPTER 13, ARTICLE 11, § 13-51, (e)(5) 4 OF THE REVISED CODE OF ORDINANCES (1988) OF THE CITY OF 5 LITTLE ROCK, ARKANSAS, TO PROVIDE FOR THE ADOPTION BY 6 REFERENCE OF THE JUNE 7, 2019, FLOOD INSURANCE STUDY AND 7 FLOOD INSURANCE RATE MAPS TO BE ADMINISTERED BY THE 8 CITY OF LITTLE ROCK AS THE EFFECTIVE MAPS; TO DECLARE 9 AN EMERGENCY; AND FOR OTHER PURPOSES. 10 11. WHEREAS, the Federal Emergency Management Agency (FEMA) has identified Special Flood 12 Hazard Areas of the City of Little Rock in the current scientific and engineering report entitled "The 13 Flood Insurance Study (FIS) for Pulaski County, Arkansas and incorporated areas," dated June 7, 2019 14 with an effective Flood Insurance Rate Map(FIRM)dated June 7,2019; and 15 WHEREAS, these Special Flood Hazard Areas are subject to periodic flooding events that result in 16 loss of life and property, pose health and safety hazards, disrupt commerce and governmental services, 17 and cause extraordinary public expenditures for flood protection and relief, all of which adversely affect 18 the public health, safety and general welfare. 19 WHEREAS, the City of Little Rock as a participant in the National Flood Insurance Program is 20 required to adopt the new Flood Insurance Rate Maps as a condition of continued participation in the 21 National Flood Insurance Program. 22 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 23 OF LITTLE ROCK,ARKANSAS: 24 Section 1. Chapter 13 of the City of Little Rock Municipal Code of Ordinances, Article II, Section 25 13-51,(b)(1)is hereby repealed and replaced with the following new provision: 26 (1) The Federal Emergency Management Agency (FEMA) has identified special flood 27 hazard areas of the City of Little Rock in the current scientific and engineering report 28 entitled "The Flood Insurance Study (FIS) for Pulaski County, Arkansas and 29 incorporated areas," dated June 7, 2019, with an effective Flood Insurance Rate Map 30 (FIRM)dated June 7,2019. 31 Section 2. Chapter 13 of the City of Little Rock Municipal Code of Ordinances, Article H, Section 32 13-51,(e)(5)is hereby repealed and replaced with the following new provision: [Page 1 of 21 1 5 This article regulates the construction of flood barriers which unnaturally divert 2 floodwaters or which may adversely impact other lands. Flood damage prevention 3 code adopted by reference. There is hereby adopted by reference a "Flood Damage 4 Prevention Code for the City of Little Rock, Arkansas," dated June 7, 2019. The 5 Code shall include: 6 Article 1 Definitions; 7 Article 2 Administration; 8 Article 3 Provisions for Flood Hazard Reduction. 9 A copy of the referenced Code shall be filed in the office of the Pulaski County 10 Circuit Clerk and shall be available for inspection and copying during normal 11 business hours. 12 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 13 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 14 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 15 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 16 resolution. 17 Section 4. Repealer.All laws, ordinances,resolutions, or parts of the same,that are inconsistent with 18 the provisions of this resolution,are hereby repealed to the extent of such inconsistency. 19 Section 5.
