21731 1 ORDINANCE NO.21,731 2 ' 3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE 4 TO BID; TO AWARD A SOLE-SOURCE AGREEMENT TO MOTOROLA 5 SOLUTIONS, INC., IN A TOTAL AMOUNT NOT TO EXCEED ONE 6 HUNDRED THIRTY-FIVE THOUSAND, FOUR HUNDRED THIRTY- 7 NINE DOLLARS ($135,439.00), PLUS APPLICABLE TAXES AND FEES, 8 TO UPGRADE SOFTWARE AND HARDWARE FOR THE NICE INFORM 9 RECORDER USED BY THE LILLTE ROCK POLICE DEPARTMENT 10 COMMUNICATIONS (911)DIVISION; AND FOR OTHER PURPOSES. 11 12 WHEREAS, the Little Police Department has a need to enter into a Sole-Source Contract with 13 Motorola, Solutions,Inc.,the parent company of NICE,to upgrade existing Software and Hardware of the 14 Communications Division's Inform Recorder; and, 15 WHEREAS,the NICE Inform Recorder is used by the Communications Division to record incoming 16 phone lines, including 911 lines has reached its functional end of life and must be upgraded to ensure the 17 equipment's continued operation;and, 18 WHEREAS,the cost of the Software and Hardware Upgrade is One Hundred Thirty-Five Thousand, 19 Four Hundred Thirty-Nine Dollars($135,439.00),plus applicable taxes and fees. 20 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 21 OF LITTLE ROCK,ARKANSAS: 22 Section 1. The Mayor and City Manager are authorized to enter into a Sole-Source Contract with 23 Motorola Solutions, Inc., the parent company of NICE to upgrade existing Software and Hardware of the 24 Communications Division's Inform Recorder at a cost not to exceed One Hundred Thirty-Five Thousand, 25. Four Hundred Thirty-Nine Dollars($135,439.00),plus applicable taxes and fees. 26 Section 2. Funding for the software and hardware upgrade is available from the following sources: 27 One Hundred Sixteen Thousand, Three Hundred Seventy-Seven Dollars ($116,377.00) from the 2018 28 Edward Byrne Justice Assistance Grant,Account No.G35165,and Nineteen Thousand,Sixty-Two Dollars 29 ($19,062.00)from the Federal Equitable Sharing Fund,Account No.F35147/8. 30 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 31 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 32 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 33 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 34 ordinance.
