21730 1 ORDINANCE NO. 21,730 2 3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE 4 TO BID; TO AWARD A SOLE-SOURCE MAINTENANCE AGREEMENT 5 TO MOTOROLA SOLUTIONS, INC., IN THE AMOUNT OF TWO 6 HUNDRED SIX THOUSAND DOLLARS ($206,000.00), INCLUDING 7 APPLICABLE TAXES AND FEES, TO PROVIDE REPAIRS AND 8 MAINTENANCE FOR THE CITY'S PORTABLE AND MOBILE 9 RADIOS; AND FOR OTHER PURPOSES. 10 11 WHEREAS,the City has utilized a Motorola System for its communications for a number of years, 12 and it is crucial to have a Maintenance Agreement in place for the System Infrastructure which includes 13 Portable and Mobile Radios used by the Little Rock Police Department, the Little Rock Fire Department, 14 the Parks & Recreation Department, the Little Rock Zoo, Housing & Neighborhood Programs, Fleet 15 Services,Public Works,Planning&Development,City Manager's Office and the District Courts;and, 16 WHEREAS,the Little Rock Police Department is requesting a Sole-Source Repair and Maintenance 17 Agreement,with two(2),one(1)-year extensions,with Motorola Solutions,Inc.,for a twelve(12)-Repair 18 and Maintenance Plan at a cost of Two Hundred Six Thousand Dollars ($206,000.00), plus applicable 19 taxes and fees to properly maintain the City's existing Portable and Mobile Radios. 20 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 21 OF LITTLE ROCK,ARKANSAS: 22 Section 1. The Mayor and City Manager are authorized to enter into a twelve (12)-month Service 23 Agreement with two (2), one (1) year extensions in the amount of Two Hundred Six Thousand Dollars 24 ($206,000.00), plus applicable taxes and fees, with Motorola Solutions, Inc., to provide Repair and 25 Maintenance to the City's existing Portable and Mobile Radios. 26 Section 2.Because of the need to have Repair and Maintenance Services authorized by Motorola and 27 Motorola Solutions,Inc., is the only entity to make an appropriate determination on this point,the Board 28 declares that it is impractical and unfeasible to submit this matter to a competitive bid process, and, 29 therefore,waives competitive bidding. `30 Section 3. Funds for the Repair and Maintenance Agreement authorized by this ordinance are 31 available in the Communications Division Budget,Account No. 105260-61130. 32 Section 4. Severability. In the event any portion of this ordinance is declared or adjudged to be 33 invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this [Page 1 of 21 I ordinance,which shall remain in full force and effect as if the portion so declared or adjudged invalid or 2 unconstitutional was not originally a part of this ordinance. 3 Section 8.
