3 A RESOLUTION AUTHORIZING THE EXECUTION OF AN
4 INTERLOCAL AGREEMENT BETWEEN THE CITY OF LITTLE
5 ROCK, ARKANSAS AND THE CITY OF CABOT, ARKANSAS,
6 GRANTING THE LITTLE ROCK AMBULANCE AUTHORITY
7 ( "LRAA ") D /B /A METROPOLITAN EMERGENCY MEDICAL
8 SERVICES ( "MEMS ") AN EXCLUSIVE FRANCHISE TO
9 PROVIDE AMBULANCE SERVICES TO THE CITY OF CABOT,
10 ARKANSAS; AND FOR OTHER PURPOSES.

12 WHEREAS, the Little Rock Ambulance Authority d/b /a Metropolitan Emergency
13 Medical Services ( "MEMS ") has been awarded an exclusive franchise to provide
14 ambulances services to the City of Cabot, and
15 WHEREAS, the Cities of Little Rock and Cabot wish to enter into an interlocal
16 agreement to provide said ambulance service, as has been done with certain cities and
17 counties adjacent to Little Rock, and
18 WHEREAS, MEMS has represented to this Board that it has the capability and
19 resources to provide such service without increasing expenses, rates, or response times
20 for Little Rock citizens or other participating entities, and
21 WHEREAS, this Board believes that it is beneficial to have MEMS provide
22 ambulance services to the City of Cabot and thereby promote the health and welfare of
23 the citizens of Little Rock and Cabot, and

I WHEREAS, the delivery of ambulance services (emergency and non - emergency)
2 to Cabot will enhance MEMS' financial soundness and increase its ability to deliver
3 high - quality emergency medical services to all citizens.
4 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
5 THE CITY OF LITTLE ROCK, ARKANSAS:
6 Section 1. The Board hereby authorizes the Mayor to enter into a three (3) year
7 interlocal agreement with the City of Cabot, Arkansas, granting MEMS an exclusive
8 franchise to provide ambulance services (emergency and non - emergency) to the City of
9 Cabot.
10 Section 2. For purposes of this resolution, the term "ambulance services" shall
11 include the transportation and care provided the critically ill or injured prior to arrival
12 at a medical facility and within a medical facility subject to the individual approval of
13 the medical staff and governing board of that facility, and further the transport to or
14 from medical facilities including but not limited to hospitals, nursing homes,
15 physician's offices, and other health care facilities, of persons who are infirm or injured
16 and who are transported in a reclining position or who are ill but considered to be non -
17 emergency in status and who request ambulance transportation.
18 Section 3. Severability. In the event any portion of this resolution is declared or
19 adjudged to be invalid or unconstitutional, such declaration or adjudication shall not
20 affect the remaining portions of this resolution, which shall remain in full force and
21 effect as if the portion so declared or adjudged invalid or unconstitutional was not
22 originally a part of this resolution.
23 Section 4. Repealer. All ordinances and resolutions, and parts thereof, which
24 are in conflict with any provision of this resolution are hereby repealed to the extent of
25 such conflict.
