19317ORDINANCE NO. 19,317 2 3 AN ORDINANCE TO ESTABLISH MUNICIPAL IMPROVEMENT 4 DISTRICT NO.9 OF LITTLE ROCK, ARKANSAS — BROOKSIDE PARK 5 PROJECT; AND FOR OTHER PURPOSES 6 7 WHEREAS, parties claiming to be a majority in value or more in assessed value of 8 real property located within the territory described in Exhibit A attached hereto, have filed 9 a petition praying that an improvement district be established for the purposes hereinafter 10 set out; and 11 WHEREAS, after due notice as required by law, the Board of Directors of the City of 12 Little Rock, Arkansas, has heard all the parties desiring to be heard, and has ascertained 13 that the petition was signed by a majority in value or more in assessed value of the owners 14 of real property within the territory; 15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 16 THE CITY OF LITTLE ROCK, ARKANSAS: 17 Section 1. There is hereby established an improvement district embracing the real 18 property attached as Exhibit A hereto for all purposes authorized by Arkansas Code 19 Annotated § 14 -88 -202 and any and all other statutes or acts which shall be deemed 20 necessary in order to purchase, construct, accept as a gift, operate and maintain any and all 21 improvements authorized herein; such purposes to be accomplished in the manner that the 22 commissioners of the district shall deem to be in the best interest of the district, and the cost 23 thereof to be assessed upon the real property above described according to the benefits 24 received. 25 Section 2. The District shall be known as "Municipal Improvement District No. 9 of 26 Little Rock, Arkansas — Brookside Park Project" and Charles L. Clifton, Sr., Charles G. [PAGE 1 OF 3] I Womack, Jr., and Curtis Golden, who are owners of real property within the District, are 2 hereby named commissioners and shall compose the Board of Improvement for the 3 District. 4 Section 3. Severability. In the event any title, section, paragraph, item, 5 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid 6 or unconstitutional, such declaration or adjudication shall not affect the remaining 7 portions of the ordinance which shall remain in full force and effect as if the portion so 8 declared or adjudged invalid or unconstitutional was not originally a part of the 9 ordinance. 10 Section 4. Repealer. All ordinances, resolutions, bylaws, and other matters 11 inconsistent with this ordinance are hereby repealed to the extent of such inconsistency. 12 Section 5. Emergency Clause.
