14933 1 RESOLUTION NO. 14,933 2 3 A RESOLUTION TO AUTHORIZE THE MAYOR, CITY MANAGER 4 AND CITY CLERK TO EXECUTE ALL DOCUMENTS REQUIRED FOR 5 THE PURCHASE AND DEMOLITION OF THE PROPERTY LOCATED 6 AT 3 CURTIS COVE FOR FLOOD MITIGATION PURPOSES; AND FOR 7 OTHER PURPOSES. 8 9 WHEREAS,the structure located at 3 Curtis Cove is located within the 100-Year Floodplain and has 10 a minimum finished floor below the base flood elevation; and, 11 WHEREAS,this structure has had a history of repetitive flood issues; and, 12 WHEREAS, a Federal Emergency Management Agency Flood Mitigation Grant was awarded to the 13 City through the Arkansas Natural Resource Conservation Commission for the acquisition of the 14 property, demolition of structures and other project expenses. 15 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 16 OF LITTLE ROCK,ARKANSAS: 17 Section 1. The Mayor, City Clerk, and City Manager are hereby authorized to execute, in a form 18 approved by the City Attorney, all documents required to purchase and convey to the City for demolition 19 the property located at 3 Curtis Cove for purpose of Flood Mitigation. The City Manager is further 20 authorized to execute contracts for grant management with the Central Arkansas Planning and 21 Development District, for an Environmental Assessment, for any asbestos abatement needed, for 22 demolition of the structure and other associated project costs. 23 Section 2. The project is 100% funded through a grant from the Federal Emergency Management 24 Agency with administrative costs from a Sales Tax Special Project with a total authorized project cost not 25 to exceed One Hundred Seventy-Three Thousand, Five Hundred Sixty Dollars ($173,560.00), which is 26 the grant award amount plus 10%contingency. 27 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 28 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 29 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 30 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 31 resolution. 32 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent 33 with the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
