14896 1 RESOLUTION NO. 14,896 2 3 A RESOLUTION TO PROHIBIT THE PURCHASE OF EXPANDED 4 POLYSTYRENE FOAM UTILIZING CITY OF LITTLE ROCK MONIES; 5 AND FOR OTHER PURPOSES. 6 7 WHEREAS,items of Expanded Polystyrene(EPS)Foam(commonly referred to by the brand name 8 "Styrofoam")are one of the top ten most littered items,which causes unsightly litter that necessitates time 9 consuming and often ineffective cleanup efforts;and, 10 WHEREAS,EPS Foam does not biodegrade,but rather breaks down into smaller particles that pollute 11 our natural and built environment; and, 12 WHEREAS,EPS Foam is made from the monomer styrene, which is a suspected human carcinogen 13 and known neurotoxin; and, 14 WHEREAS,the City of Little Rock has banned the use of Styrofoam within City facilities for the past 15 five(5)years; and, 16 WHEREAS,the City of Little Rock declares it is in the best interest of the health and welfare of its 17 residents,visitors,and employees to reduce litter and pollutants on the land and in the waters of Little Rock; 18 and, 19 WHEREAS,the City of Little Rock is dedicated to reducing the volume of items entering the Little 20 Rock landfill through holistic recycling programs;and, 21 WHEREAS,while the City of Little Rock has a robust recycling program it is not feasible or cost- 22 effective to recycle EPS Foam;and, 23 WHEREAS,there are readily available alternatives to EPS that can be recycled or composted in Little 24 Rock. 25 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF TIIE CITY 26 OF LITTLE ROCK,ARKANSAS: 27 Section 1. The Board of Directors hereby prohibits the purchase of Expanded Polystyrene(EPS)Foam 28 products by City Departments and further prohibits any businesses, including but not limited to catering 29 companies, from providing Expanded Polystyrene Foam products when the City of Little Rock has 30 purchased their services. 31 Section 2. Acceptable alternatives to EPS Foam products include but are not limited to polyethylene 32 and polypropylene plastic products,fiber products and compostable products. 33 Section 3. The Board of Directors further agrees to support the general goal of reducing EPS Foam 34 product use by citizens, other government entities, and businesses throughout the City of Little Rock by [Page 1 of 2] 1 promoting awareness of the issues surrounding EPS Foam and by promoting the adoption of EPS Foam 2 alternatives. 3 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 4 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 5 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 6 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 7 resolution. 8 Section 5.Repealer.
