14894 1 - RESOLUTION NO. 14,894 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO UTILITY RELOCATION AGREEMENTS NECESSARY TO 5 CONSTRUCT THE 2016 - 2018 STREET AND DRAINAGE CAPITAL 6 IMPROVEMENT PROGRAM, AS AUTHORIZED BY RESOLUTION NO. 7 14,310 (MARCH 15,2016); AND FOR OTHER PURPOSES. 8 9 WHEREAS, the Public Works Department has initiated a capital improvement program funded by 10 the 2013 Capital Improvements Bonds for Streets and Drainage Projects and the 3/8-Cent Capital 11 Improvement Sales and Compensating Use Tax for constructing Street and Drainage Improvement Projects 12 throughout the City as authorized by Resolution No. 14,310 adopted by the Board on March 15,2016;and, 13 WHEREAS,the relocation of public utilities are sometimes necessary to accomplish the construction 14 and maintenance of street and drainage improvements. 15 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 16 OF LITTLE ROCK,ARKANSAS: 17 Section 1. The City Manager is hereby authorized to Utility Relocation Agreements for the 18 reimbursement of relocation expenses not covered by existing Utility Franchise Agreements as may be 19 needed to complete the projects identified in Resolution No. 13,699,as amended. 20 Section 2. Funding for relocation expenses is from the amounts allocated to each Ward for the 21 Compensating Use Tax Funds as authorized by Resolution 14,310. 22 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 23 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 24 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 25 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 26 resolution. 27 Section 4.
