3 A RESOLUTION TO AMEND LITTLE ROCK, ARK., RESOLUTION NO.
4 14,869 (OCTOBER 1, 2018) TO ESTABLISH THAT THE CORRECT
5 PERIMETERS FOR THE STREET AND DRAINGAGE IMPROVEMENTS
6 ON MABELVALE WEST ROAD TO BE COMPLETED BY JAMES A.
7 ROGERS EXCAVING, INC., IS FROM OTTER CREEK EAST ROAD TO
8 SOUTH LOOP ROAD; AND FOR OTHER PURPOSES.

10 WHEREAS, in Little Rock, Ark., Resolution No. 14,869 (October 1, 2018) the Board of Directors
11 authorized Street and Drainage Improvements on Mabelvale West Road; and,
12 WHEREAS,the Street and Drainage Improvement Plan will widen the street to four(4)travel lanes
13 in each direction with a center turn-lane and provide storm sewer, curb, gutter and sidewalks; and,
14 WHEREAS, it has been discovered that Resolution No. 14,869 (October 1, 2018) incorrectly defined
15 the improvement perimeters on Mabelvale West Road from Mabelvale South Road to South Loop Road;
16 and,
17 WHEREAS, Bid No. 18032 was awarded James A. Rogers Excavating, Inc., for the Street and
18 Drainage Improvements to Mabelvale West Road from Otter Creek East Road to South Loop Road.
19 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
20 OF LITTLE ROCK,ARKANSAS:
21 Section 1. Section 1 of Little Rock,Ark.,Resolution No. 14,869(October 1,2018)is amended to read
22 as follows:
23 The City Manager is hereby authorized to enter into a contract with James A. Rogers
24 Excavating,Inc.,for the Mabelvale West Road Improvements from Otter Creek East Road
25 to South Loop Road, in an amount not to exceed Six Hundred Twenty Thousand, Three
26 Hundred Eighty-Eight Dollars ($620,388.00), which is the base bid amount of Five
27 Hundred Sixteen Thousand, Nine Hundred Ninety Dollars ($516,990.00), plus 20%
28 contingencies.
29 Section 2. Any aspect of Little Rock,Ark.,Resolution No. 14,869(October 1,2018)which references
30 that the Road Improvements set forth in Section 1 of this resolution is to be made from Mabelvale South
31 Road is hereby amended to refer to Otter Creek East Road.
32 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
33 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
34 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and

1 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
2 resolution.
3 Section 4. Repealer. All resolutions, bylaws, and other matters inconsistent with this resolution are
4 hereby repealed to the extent of such inconsistency including, but not limited to, Little Rock, Ark.,
5 Resolution No. 14,869(October 1,2018).
