2 A RESOLUTION TO AWARD A LEASE TO THE ARKANSAS GAME & FISH COMMIS-
3 SION TO DEVELOP A NATURE CENTER IN THE JULIUS C. BRECKLING RIVERFRONT
4 PARK FOR A TERM OF NINETY -NINE (99) YEARS; AND FOR OTHER PURPOSES.

6 WHEREAS, the City set out in detail a plan for developing a "city in a park" as a part of the
7 Little Rock Parks & Recreation Master Plan, codified in Little Rock, Ark., Ordinance No. 18,528
8 Uuly 17, 2001)( "Parks & Recreation Master Plan "), and
9 WHEREAS, the Parks & Recreation Master Plan wanted to develop partnerships for the devel-
10 opment of programs throughout the City, and especially to enhance the chain of parks concept
11 along the City's northern border with the Arkansas River, and
12 WHEREAS, the City stated its intent to cooperate with the Arkansas Game & Fish Commission
13 ( "the Commission ") in the creation of a nature center in Little Rock, Ark., Resolution No. 11,714
14 (March 16, 2004), and
15 WHEREAS, the Commission, having announced the creation of the Witt Stephens, Jr. Central
16 Arkansas Nature Center in the City, presented the only proposal -- a very qualified proposal --
17 in response to Bid No. 5354, which ran for four weeks in the newspaper in accordance with the
18 provisions of Ark. Code Ann. § 22- 4- 501(a)(2)(West 2004), and has been selected by a commit -
19 tee appointed by the City Manager to be awarded a the lease of this property,
20 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
21 ROCK, ARKANSAS:
22 Section 1. The City Manager and City Clerk are authorized to enter into a lease agreement,
23 for a term not to exceed ninety -nine (99) years, with the Arkansas Game & Fish Commission, to
24 lease the property described in Exhibit A to this Resolution for the purpose of constructing,
25 maintaining, and operating a nature center that shall be open to the public.
26 Section 2. The lease agreement may be executed by the City Manager and the City Clerk
27 once it has received approval as to legal from by the City Attorney, provided that the lease as-

I sures the nature center will be open to the public, will include education programs and exhibits,
2 and other features, which will enable visitors to learn more about the flora and fauna in Arkan-
3 sas, and otherwise conforms to Bid No. 5354 and any response made to that bid by the Com-
4 mission.
5 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,
6 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional,
7 such declaration or adjudication shall not affect the remaining portions of the resolution which
8 shall remain in full force and effect as if the portion so declared or adjudged invalid or uncon-
9 stitutional was not originally a part of the resolution since the purpose of the resolution is to
10 assure that the described lands in the Julius C. Breckling Riverfront Park are leased to the
11 Commission for the purpose of constructing, maintaining and operating a nature center open to
12 the public.
13 Section 4. Repealer. All resolutions and other matters, including but not limited to Little
14 Rock, Ark., Resolution No. 1 1,714 (March 16, 2004), are hereby repealed to the extent of any
15 consistency.

PROPERTY DESCRIPTION OF LEASED PROPERTY
A tract of land situated in the Northwest Quarter of Section Two, Township One
North, Range Twelve West of the Fifth Principal Meridian, (A pt. Of the NW 'Y4 Sec.2, T.1
N., R.1 2 W., 5th P.M.), located in Pulaski County, Arkansas, being more particularly de-
scribed as follows:
BEGINNING at the intersection of the Western Right of Way of Interstate Thirty (1 -30)
and the Northern Right of Way of the Missouri Pacific Railroad as depicted on a map of
Riverfront Park for the City of Little Rock by Garver & Garver Engineers, .Job No. 21480;
THENCE: North 86 degrees 20 minutes 40 seconds West, approximately 435 feet
along the Northern Right of Way of the aforesaid Missouri Pacific Railroad, said point is
the Southerly projection of the Easternmost curb line of the City of Little Rock's Am-
phitheater parking lot;
THENCE: Northerly along the projection line of the Easternmost curb line and along
said aforementioned curb line, approximately 325 feet to the ordinary high water mark
on the right bank of the Arkansas River;
THENCE: Easterly along the ordinary high water mark on the right bank of the Ar-
kansas River approximately 350 feet to the Western Right of Way of Interstate Thirty (I-
30);
THENCE: Southeasterly along said Western Right of Way of Interstate Thirty (1 -30),
approximately 345 feet to the POINT OF BEGINNNG.
Said property subject to easements, covenants and other restrictions of record and
contains 2.93 acres, more or less.
