19468ORDINANCE NO. 19,468 AN ORDINANCE APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED RESIDENTIAL DISTRICT TITLED PINNACLE VALLEY COURT LONG -FORM PD -R (Z- 7952), AND GRANTING A VARIANCE FROM VARIOUS LOT DEVELOPMENT STANDARDS OF CHAPTER 31 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS, PROVIDING FOR A VARIANCE TO ALLOW THE DEVELOPMENT OF DOUBLE FRONTAGE LOTS AND A VARIANCE TO ALLOW A REDUCED BUILDING LINE ADJACENT TO AN ARTERIAL ROADWAY; LOCATED ON PINNACLE VALLEY ROAD, JUST NORTH OF CANTRELL ROAD, LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from R -2 to PD -R: A part of the southwest quarter of the southeast quarter of Section 18, Township 2 North, Range Thirteen West, being more particularly described as follows: Commencing at the south quarter corner of said Section 18, Thence North 01'38'10" east along the line between S '/4 corner and the north quarter corner of said Section 18, a distance of 1331.24 feet to a point, thence leaving said line south 88 °21'50" east a distance of 3.67 feet to a 4" x 4" concrete monument, said point being the point of beginning; thence south 87 °54'02" east a distance of 662.52 feet to a ' /z" rebar; thence south 01'37'31" west a distance of 850.97 feet to a point on the northern right of way line of Pinnacle Valley Road; thence along said right of way line north 35 °59 "23" west a distance of 324.68 feet to a point thence continuing along said northern right of way along a curve to the left to a point, said curve having a radius of 842.60 feet with a chord direction of north 42'37'18" west and a chord distance of 194.49 feet; thence continuing along said northern right of way north 49 °10'23" west a distance of 423.56 feet to a ' /z" rebar set in concrete; thence leaving said northern right of way north 01 °30'25" east a distance of 192.22 feet to the point of beginning containing 7.36 acres or 320,627.59 square feet, more or less, and subject to any easements, rights of way or restrictions of record, if any. SECTION 2. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 3. That the change in zoning classification contemplated for Pinnacle Valley Court Long -form PD -R (Z- 7952), located on Pinnacle Valley Road, just North of Cantrell Road is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 4. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 5: That a variance from various lot design standards of Chapter 31 of the Code of Ordinances is granted to provide for variances of certain requirements within the Subdivision Regulations of the City of Little Rock for the Shackleford Commercial Preliminary Plat as follows: Subsection a. That variances are granted from the provisions of Chapter 31, Section 31 -256 (2) for the Pinnacle Valley Court Subdivision Preliminary Plat; Lots 2 — 14 the development of lots with a reduced building line. Subsection b. That variances are granted from the provisions of Chapter 31, Section 31 -232 (d) for the Pinnacle Valley Court Subdivision Preliminary Plat; Lots 2 — 14 the development of double frontage lots. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
