3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO EXECUTE
4 A CONTRACT WITH OAKLEY FERTILIZER, INC., IN AN AMOUNT
5 NOT TO EXCEED THREE HUNDRED THOUSAND DOLLARS
6 ($300,000.00),FOR THE PURCHASE OF ROCK SALT IN BULK FOR THE
7 PUBLIC WORKS DEPARTMENT; AND FOR OTHER PURPOSES.

9 WHEREAS,the Public Works Department has a need to purchase Rock Salt in bulk to prepare for the
10 possibility of inclement weather; and,
11 WHEREAS,the Public Works Department has obtained a bid quote from Oakley Fertilizer, Inc., for
12 Rock Salt in bulk at One Hundred Two Dollars ($102.00) per ton, as needed, for a period of one(1)-year,
13 with an additional one(1)-year extension, if agreed to by both parties; and,
14 WHEREAS, the Public Works Department has also consulted with the Arkansas Department of
15 Transportation, Bid Contract No. H-19-201J, which lists Oakley Fertilizer, Inc., as being the lowest
16 responsible bidder meeting specifications.
17 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
18 OF LITTLE ROCK,ARKANSAS:
19 Section 1. The City Manager is authorized to enter into a contract with Oakley Fertilizer,Inc.,for the
20 purchase of Rock Salt in bulk at One Hundred Two Dollars($102.00)per ton,as needed, in an amount not
21 to exceed Three Hundred Thousand Dollars ($300,000.00)for a period of one(1)-year,with an additional
22 one(1)-year extension, if agreed to by both parties.
23 Section 2. Funds for this purchase are purchase are allocated in Streets & Drainage Maintenance,
24 Account No. 204003 -61020.
25 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
26 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
27 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
28 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
29 resolution.
30 Section 4. Repealer. All laws, ordinances,resolutions,or parts of the same,that are inconsistent with
31 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
