3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A COOPERATIVE AND COST SHARING AGREEMENT WITH
5 THE LITTLE ROCK SCHOOL DISTRICT, TO CONSTRUCT
6 IMPROVEMENTS ON MABELVALE PIKE FROM HELM STREET TO
7 NORTH OF RICH SMITH LANE; AND FOR OTHER PURPOSES

9 WHEREAS, the Little Rock School District has made a commitment to construct a new roundabout
10 intersection at Mabelvale Pike and Sibley Hole Road and to construct a left -turn lane for bus traffic at the
11 new Southwest School driveway to the south of Sibley Hole Road; and,
12 WHEREAS, the Little Rock Board of Directors has authorized by Resolution No. 14,803, an
13 improvement project on Mabelvale Pike from Helm Street to north of Rich Smith Lane, to complete
14 improvements that were not a part of the approved School District Improvement Plans; and,
15 WHEREAS, it is desirable for the Little Rock School District and the City of Little Rock to enter into
16 a Cooperative and Cost Sharing Agreement with the mutual goal to efficiently and expeditiously complete
17 design work, acquire right-of-way and construct the improvements to Mabelvale Pike as described herein.
18 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
19 OF LITTLE ROCK, ARKANSAS:
20 Section 1. The City Manager is hereby authorized to execute an agreement, the form and terms of
21 which have been approved by the City Attorney, with the Little Rock School District for the construction
22 of the Mabelvale Pike Improvements, The agreement shall set forth the responsibilities of each party for
23 design, right-of-way acquisition, construction and cost sharing according to the commitments that have
24 been made by the Little Rock Board of Directors and the Little Rock School District for funding the
25 improvements.
26 Section 2. Funding for this project is from the 2013 — 2018 Capital Improvements Bonds for Streets
27 and Drainage and the %-Cent Capital Improvement Sales and Compensating Use Tax Funds as authorized
28 by Resolution No. 14,803.
29 Section 3. Severability. In the event any title, section, paragraph, item,. sentence, clause, phrase, or
30 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
31 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
32 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
33 resolution.

Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with
the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
