1945410 2 ORDINANCE NO. 19,454 3 AN ORDINANCE TO ABANDON A PORTION OF GAMBLE 4 ROAD LOCATED WITHIN TRACT 10, AND A PORTION OF OLD 5 MARKHAM STREET IN TRACT 7, HILLVALE ADDITION, IN THE 6 CITY OF LITTLE ROCK AS A PUBLIC RIGHT -OF -WAY; AND FOR 7 OTHER PURPOSES. 9 WHEREAS, a request was made to abandon a public right -of -way for a portion 10 of Gamble Road located within Tract 10, Hillvale Addition, lying North of the North 11 right -of -way line of Chenal Parkway, and that portion of Old Markham Street, lying 12 South of and adjacent to the East 1/2 of Tract 7, Hillvale Addition, pursuant to the City's 13 general police power authority under Ark. Code Ann. § 14 -54 -104; 14 WHEREAS, the Board has determined that the abandoning of this public right - 15 of -way will not have an adverse impact on the adjacent property owners nor the local 16 traffic, and therefore, the right -of -way abandoned by this ordinance is no longer needed 17 for corporate purposes, except as otherwise noted below. 18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 19 OF THE CITY OF LITTLE ROCK, ARKANSAS: 20 Section 1. The Board of Directors hereby releases, vacates, and abandons the 21 portion of Gamble Road located within Tract 10, Hillvale Addition lying North of the 22 North right -of -way line of Chenal Parkway, and that portion of Old Markham Street 23 lying South of and adjacent to the East 1/2 of Tract 7, Hillvale Addition, together with the 24 right of public in general, in the City of Little Rock, Pulaski County, Arkansas. 25 Section 2. The City specifically reserves the public utility easements within the 26 former right -of -way. [PAGE 1 OF 2] Ordinance To abandon a portion of Gamble Road I Section 3. A copy of this ordinance duly certified by the City Clerk, shall be filed 2 in the real estate records of the recorder of the Circuit Clerk in ex officio recorder of 3 Pulaski County, Arkansas. 4 Section 4. Severability. In the event any title, section, paragraph, item, 5 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid 6 or unconstitutional, such declaration or adjudication shall not affect the remaining 7 portions of the ordinance which shall remain in full force and effect as if the portion so 8 declared or adjudged to be invalid or unconstitutional was not originally a part of the 9 ordinance. 10 Section 5. Repealer.
