14815 1 RESOLUTION NO. 14,815 2 3 A RESOLUTION TO AUTHORIZE THE PURCHASE OF PROPERTY 4 OFFERED FOR SALE TO THE CITY OF LITTLE ROCK, ARKANSAS, 5 TO BE USED FOR NEIGHBORHOOD REVITALIZATION PROGRAMS; 6 AND FOR OTHER PURPOSES. 7 8 WHEREAS, the Board of Directors has stated as one of its goals a desire to provide for 9 neighborhood revitalization, and has taken special efforts to accomplish this goal through its use of 10 various City and Federal Funds, and in affirmative actions such as the creation of a Land Bank 11 Commission; and, 12 WHEREAS, in order to accomplish this goal is it required that properties be obtained and sold by the 13 City in areas that are appropriate for revitalization; and, 14 WHEREAS,Lee Redwood, 6320 Brookside Plaza, Unit 277, Kansas City,MO, 64113, has indicated 15 a desire to sell the property located at 2021 South Maple Street to the City of Little Rock; and, 16 WHEREAS, the City wishes to purchase the property for use in its neighborhood revitalization 17 efforts; and, 18 WHEREAS, City Staff has conducted a title search of the property which revealed valid title to the 19 properties and no significant title issues; and, 20 WHEREAS, the City has performed an environmental assessment of the property pursuant to 24 21 C.F.R. § 58, et seq. (2003),which revealed no environmental problems; and, 22 WHEREAS, in consideration for Nineteen Thousand Dollars($19,000.00),the City will purchase the 23 property for the public purpose of neighborhood revitalization, and, 24 WHEREAS, funds to pay the purchase price for the parcel is available in Land Bank's Community 25 Development Block Grant(CDBG)Account No. G62412; and, 26 WHEREAS,Lee Redwood has provided the City with a Real Estate Contract for the property; and, 27 WHEREAS, Lee Redwood will provide the City of Little Rock with a Warranty Deed to the 28 properties, shown in attached Exhibit B, 29 WHEREAS,Arkansas State Law requires that the City acquire the property by resolution adopted by 30 the Board of Directors; 31 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 32 OF LITTLE ROCK,ARKANSAS: 33 Section 1. Pursuant to Ark. Code Ann. § 14-54-302(c) (West Supp. 2010), the City must obtain 34 authority from the Board of Directors to purchase the property listed in Exhibit A to this resolution. [Page 1 of 6] 1 Section 2. The Board of Directors, pursuant to Ark. Code Ann. § 14-54-302(c) (West Supp. 2010), 2 must authorize the Mayor and City Clerk to execute any documents necessary to complete the purchase of 3 the properties listed in Exhibit A to this resolution. 4 Section 3. The property will be used for a public purpose to serve the public, specifically to improve 5 city revitalization programs. 6 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 7 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 8 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 9 effect a if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 10 resolution. 11 Section 5.Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with 12 the provisions of this resolution are hereby repealed to the extent of such inconsistency. 13 ADOPTED: July 2,2018 14 AT S.'.
