3 AN ORDINANCE TO GRANT A FRANCHISE TO THE LaMARCHE
4 PLACE PROPERTY OWNERS ASSOCIATION FOR THE PLACEMENT
5 OF SEVEN(7) SECURITY CAMERAS IN THE RIGHT-OF-WAY OF THE
6 INTERSECTION OF LaMARCHE BOULEVARD AND LaMARCHE
7 DRIVE; AND FOR OTHER PURPOSES.

9 WHEREAS,the LaMarche Place Property Owners Association("LaMarche Place POA")applied for
10 a franchise that would allow the installation of seven(7)security cameras as part of their landscaped entry
11 within the LaMarche Place Boulevard right-of-way;and,
12 WHEREAS, installation of the security cameras will require a three(3)-inch bore under the entrance
13 drives and roadways for insertion of electrical and video conduits as shown on Exhibit A attached hereto
14 and incorporated herein by this reference;and,
15 WHEREAS,the security cameras,will be mounted on stone pillars that are a part of the entry walls;
16 and,
17 WHEREAS,the security cameras will be placed at the locations shown on Exhibit A approximately
18 seven(7)to eight(8)feet above the ground to deter vandalism;and,
19 WHEREAS,the City of Little Rock does not assume responsibility to maintain or replace any conduit
20 or security camera placed in the public right-of-way by the LaMarche Place POA; and,
21 WHEREAS,as a condition of the grant of this franchise,the LaMarche Place POA shall hold the City
22 harmless from and all damages, liability and expenses that arise out of any claim against the City by any
23 person,firm,corporation,partnership or company for which the City may become liable as a result of any
24 act or omission of the LaMarche Place POA as it relates to the installation,ownership and operation of the
25 franchised items installed and operated by the LaMarche Place POA in the public right-of-way.
26 NOW,THEREFORE,BE IT ORDAINED BY DIE BOARD OF DIRECTORS OF THE CITY
27 OF LITTLE ROCK,ARKANSAS:
28 Section 1. The LaMarche Place POA is hereby granted a franchise to install seven(7)security cameras,
29 all to be placed in the LaMarche Place Boulevard right-of-way at the locations identified on Exhibit A. The
30 franchise is subject to all the terms and conditions contained in the franchise application and this ordinance.
31 Section 2. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph,
32 item, sentence, clause, phrase or word of this ordinance is declared or adjudged to be invalid or

1 unconstitutional,such declaration or adjudication shall not affect the remaining provisions of this ordinance,
2 as if such invalid or unconstitutional provision was not originally a part of this ordinance.
3 Section 3. Repealer. All ordinances, resolutions, bylaws, and,other matters inconsistent with this
4 ordinance are hereby repealed to the extent of such inconsistency.
