3 A RESOLUTION TO AUTHORIZE
THE CITY MANAGER TO EXECUTE
4 AN AGREEMENT, IN THE AMOUNT OF THREE HUNDRED NINETY-
5 NINE THOUSAND, FIVE HUNDRED FIFTY-ONE AND 81/100 DOLLARS
• 6 ($399,551.81), FOR THE REPLACEMENT OF EQUIPMENT FOR THE
7 JIM DAILEY FITNESS & AQUATIC CENTER PURSUANT TO A LEASE-
8 PURCHASE AGREEMENT WITH NATIONAL COOPERATIVE
9 LEASING; AND FOR OTHER PURPOSES.

11 WHEREAS, it has been determined that the equipment at the Jim Dailey Fitness & Aquatic Center
12 must be replaced,and that it is possible for the City to make this purchase pursuant to National Joint Powers
13 Alliance("NJPA")without the need for formal competitive bids,and further to lease this equipment to own
14 for One Dollar($1.00)over a five(5)-year period; and,
15 WHEREAS,this methodology is the most efficient and economical way to obtain this equipment from
16 Push Pedal Pull;
17 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
18 OF LITTLE ROCK,ARKANSAS:
19 Section 1. The City Manager is authorized to execute an agreement, in a form acceptable to the City
20 Attorney, for the lease purchase of replacement equipment for the Jim Dailey Fitness &Aquatic Center in
21 an amount not to exceed Three Hundred Ninety-Nine Thousand, Five Hundred Fifty-One and 18/100
22 Dollars ($399,551.18), provided that at the end of five (5) years from entry into the lease the City is
23 permitted to purchase the equipment for an amount not to exceed One Dollar($1.00).
24 Section 2. Funding for this purchase is available in Account No. 104801-63390.
25 Section 3. This lease purchase agreement is available to the City through NJPA Contract No. 120215-
26 PCR with financing arranged through NJPA Contract No. 032615-NCL using the services of National
27 Cooperative Leasing.
28 Section 4. This lease purchase shall include the equipment and installation,costs set forth in Exhibit
29 A to this resolution.
30 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
31 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
32 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and

1 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
2 resolution.
3 Section 4. Repealer. All laws, ordinances,resolutions, or parts of the same,that are inconsistent with
4 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
