14766 1 RESOLUTION NO. 14,766 2 3 A RESOLUTION EXPRESSING THE WILLINGNESS OF THE CITY OF 4 LITTLE ROCK, ARKANSAS, TO UTILIZE FEDERAL-AID 5 TRANSPORTATION ALTERNATIVE PROGRAM FUNDS AND TO 6 AUTHORIZE THE MAYOR AND CITY MANAGER TO EXECUTE ANY 7 AND ALL NECESSARY AGREEMENTS AND CONTRACTS FOR ITS 8 ADMINISTRATION; AND FOR OTHER PURPOSES. 9 10 WHEREAS, The City of Little Rock, Arkansas, understands that Federal-Aid Transportation Funds 11 are available from the Arkansas Department of Transportation at 80%Federal participation and 20% local 12 match/in-kind labor to develop or improve Cedar Hill Road to the Arkansas River Trail Connection; and 13 WHEREAS,The City of Little Rock understands that Federal-Aid Funds are available for this project 14 on a reimbursable basis,requiring work to be accomplished and proof of payment prior to actual monetary 15 reimbursement, and 16 WHEREAS, The City is submitting a grant application for Bicycle and Pedestrian Improvements on 17 and along Cedar Hill Road, including sidewalk repair,bike lanes and a shared-use trail in Allsop Park; 18 WHEREAS, this project, using Federal Funding, will be open and available for use by the general 19 public and maintained by the applicant for the life of the project. 20 NOW, THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 21 OF LITTLE ROCK,ARKANSAS: 22 Section 1. Board of Directors of the City of Little Rock wish to participate in the use of Transportation 23 Alternative Program Grants in accordance with its designated responsibility, including maintenance of this 24 project. 25 Section 2. In the event that the grant funds are awarded,the City Manager, or his authorized designee, 26 are hereby authorized and directed to execute all appropriate agreements and contracts necessary to expedite 27 the construction of the above stated project. 28 Section 3. The Board of Directors pledges its full support and hereby authorizes the City Manager to 29 apply for the grant and for the Arkansas Department of Transportation to initiate action to implement this 30 project. 31 Section 4. Severability. In the event any title, subtitle, section, subsection, subdivision, paragraph, 32 subparagraph,item,sentence,clause,phrase,or work of this resolution is declared or adjudged to be invalid 33 or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution [Page 1 of 2] 1 which shall remain in full force and effect as if the portion so declared or adjudged invalid or 2 unconstitutional was not originally a part of this resolution. 3 Section 5. Repealer.
