3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT TO BURKHALTER TECHNOLOGIES, INC., IN AN
5 AMOUNT NOT TO EXCEED ONE HUNDRED NINETY-THREE
6 THOUSAND, FOUR HUNDRED SEVENTY-SIX AND 48/100 DOLLARS
7 ($193,476.48), FOR THE PENNBROOK CLOVERHILL DRAINAGE
8 IMPROVEMENT PROJECT; AND FOR OTHER PURPOSES

10 WHEREAS, the Pennbrook Cloverhill Neighborhood, between Bailey Road and Rock Creek, has a
11 need for channel clearing and improvements, including construction of a headwall and retaining wall; and
12 WHEREAS,Bids were solicited for construction of the Pennbrook Cloverhill Drainage Improvement
13 Project No. 16-6-DR-34, Bid No. 18005; and
14 WHEREAS, Burkhalter Technologies, Inc., was the lowest responsive, responsible bid meeting
15 specifications.
16 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK,ARKANSAS:
18 Section 1. The City Manager is hereby authorized to execute an agreement with Burkhalter
19 Technologies,Inc., for the Pennbrook Cloverhill Drainage Improvement Project No. 16-6-DR-34,Bid No.
20 18-005, in an amount not to exceed One Hundred Ninety-Three Thousand,Four Hundred Seventy-Six and
21 48/100 Dollars ($193,476.48), which is the base bid amount of One Hundred Sixty-One Thousand, Two
22 Hundred Thirty and 40/100 Dollars($161,230.40),plus 20%contingencies.
23 Section 2. Funding for this project is from the%-Cent Capital Improvement Sales and Compensating
24 Use Tax Funds,Account No. TS6B099, as authorized by Resolution No. 14,310.
25 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
26 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
27 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
28 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
29 resolution.
30 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same,that are inconsistent with
31 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
