9 WHEREAS, a Petition to form City of Little Rock Municipal Property Owners' Multipurpose
10 Improvement District No.2018-329(Piper Lane Recreation District)has been filed with the Little Rock
11 City Clerk; and
12 WHEREAS,the City Clerk has presented the petition to the Mayor; and
13 WHEREAS,the Mayor has set the regular March 20,2018,meeting which begins at 6:00 PM as the
14 date and time for a hearing before the Little Rock Board of Directors for consideration of the petition;and
15 WHEREAS,the Little Rock Board of Directors has determined from an Abstractor's Certificate of
16 Property Ownership that those signing the petition constitute all the owners of the real property to be
17 located in said District; and
18 WHEREAS,the Arkansas Municipal Property Owners'Improvement District Law provides that if the
19 governing body determines that all the owners of the real property to be located in the District have
20 petitioned for the improvements,it shall then be its duty by ordinance to establish and lay off the District
21 as defined in the petition and to appoint the Commissioners named in the petition.
22 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
23 OF LITTLE ROCK,ARKANSAS:
24 Section 1. That the real propertydescribed in Exhibit A
attached hereto and made a part hereof is
25 hereby established and laid off as City of Little Rock Municipal Property Owners' Multipurpose
26 Improvement District No. 2018-329P'

p rpose of providing
27 recreational facilities and maintaining the infrastructure and improvements within the District,together
28 with facilities related to any of the foregoing within said District.
29 Section 2. The following three (3) individuals are hereby appointed as Commissioners of said
30 Improvement District: Robert Graham Smith; Scott M. Hurley; and Zack DeYmaz.
31 Section 3. The name of improvement district shall be City of Little Rock Municipal Property Owners'
32 Multipurpose Improvement District No. 2018-329(Piper Lane Recreation District).
33 Section 4. Severability. In the event anyportion
of this ordinance is declared or adjudged to be

34 invalid or unconstitutional,such declaration or adjudication shall not affect the remaining portions of this

1 ordinance,which shall remain in full force and effect as if the portion so declared or adjudged invalid or
2 unconstitutional was not originally a part of this ordinance.
3 Section 5.Repealer. All ordinances and resolutions,and parts thereof,which are in conflict with any
4 provision of this ordinance are hereby repealed to the extent of such conflict.
5 Section 6.Emergency. The Board ofDirectors hereby determines that there is a need for additional
6 infrastructure within the City and hereby determines that the passage of this ordinance will facilitate
7 construction of additional infrastructure within the City; therefore, an emergency is hereby declared to
8 exist, and this ordinance being necessary for the public health, safetyand welfare shall be in fullforce
9 and effect from and after its passage and approval.
