8 WHEREAS, a Petition to form City of Little Rock Municipal Property Owners' Multipurpose
9 Improvement District No. 2018-328(Piper Lane Project)has been filed with the Little Rock City Clerk;and
10 WHEREAS,the City Clerk has presented the petition to the Mayor; and
11 WHEREAS,the Mayor has set the regular March 20,2018,meeting which begins at 6:00 PM as the date
12 and time for a hearing before the Little Rock Board of Directors for consideration of the petition; and
13 WHEREAS, the Little Rock Board of Directors has determined from an Abstractor's Certificate of
14 Property Ownership that those signing the petition constitute all the owners of the real property to be located in
15 said District; and
16 WHEREAS,the Arkansas Municipal Property Owners'Improvement District Law provides that if the
17 governing body determines that all the owners of the real property to be located in the District have petitioned
18 for the improvements,it shall then be its duty by ordinance to establish and lay off the District as defined in the
19 petition and to appoint the Commissioners named in the petition.
20 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
21 LITTLE ROCK,ARKANSAS:
22 Section 1. That the real property described in Exhibit A attached hereto and made a part hereof is hereby
23 established and laid off as City of Little Rock Municipal Property Owners'Multipurpose Improvement District
24 No. 2018-328 (Piper Lane Project) for the purpose of constructing and installing facilities for waterworks,
25 recreation, drainage, gas pipelines, underground trenches and excavations necessary for the installation of
26 electric and telephone distribution systems, sanitary sewers, streets, including curbs and gutters, sidewalks,
27 together with facilities related to any of the foregoing within said District.
28 Section 2. The following three (3) individuals are hereby appointed as Commissioners of said
29 Improvement District: Robert Graham Smith; Scott M. Hurley; and Zack DeYmaz.
30 Section 3. The name of Improvement District shall be City of Little Rock Municipal Property Owners'
31 Multipurpose Improvement District No. 2018-328 (Piper Lane Project).
32 Section 4.Severability.In the event any portion of this ordinance is declared or adjudged to be invalid or
33 unconstitutional, such declaration or adjudication shall not affect the remaining portions of this ordinance,

1 which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional
2 was not originally a part of this ordinance.
3 Section 5. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with any
4 provision of this ordinance are hereby repealed to the extent of such conflict.
5 Section 6.Emergency. The Board of Directors hereby determines that there is a need for additional
6 infrastructure within the City and hereby determines that the passage of this ordinance will facilitate
7 construction of additional infrastructure within the City;therefore, an emergency is hereby declared to exist,
8 and this ordinance being necessary for the public health, safety and welfare shall be in full force and effect
9 from and after its passage and approval.
