ORDINANCE NO. 19,445
3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., REV. CODE § 2 -251 (1988) TO
4 REPEAL PUBLICATION REQUIREMENTS; TO DECLARE AN EMERGENCY; AND, FOR
5 OTHER PURPOSES.

7 WHEREAS, in 2001 pursuant to Little Rock, Ark., Ordinance No. 18,605 (December
8 18, 2001), the Board of Directors passed a set of exacting criteria as to the form of
9 City financial reporting standards in order to assure a consistent basis of accounting
10 for City funds, the reconciliation of City accounts, and the form and publication of
11 monthly financial reports, quarterly fund balance reports, and semi - annual financial
12 reports, and
13 WHEREAS, this ordinance is codified as Little Rock, Ark., Rev. Code §§ 2 -245 to -
14 260.2 (1988), and
15 WHEREAS, Section 2 -251 includes publication requirements in a daily newspaper
16 that has the annual city contract for publication of notices, as well as publication in a
17 newspaper of general and daily publication including weekends, and
18 WHEREAS, since that requirement was imposed the City has vastly improved its
19 website www.littlerock.org and has taken steps to assure prompt publication of City
20 events including the agenda for meetings of the Board of Directors, and
21 WHEREAS, in the last four years the use of the internet has vastly increased, and the
22 City has continued to assure on -line access at various locations throughout the City in
23 cooperation with the Central Arkansas Library System, and is aware that access is also
24 available through private internet service, internet service at an individual's worksite,
25 and internet service at local schools, and

1 WHEREAS, it costs at least ten thousands ($10,000) dollars to meet this reporting
2 requirement and these funds could be better used to support other City operations,
3 particularly since the City has the capability to provide these reports on its website in a
4 format that is easily downloaded to be reviewed in detail by anyone wishing to do so,
5 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
6 LITTLE ROCK, ARKANSAS:
7 Section 1. The following provisions of Little Rock, Ark., Rev. Code § 2 -251 (1988)
8 are hereby repealed:
9 (a) Section 2 -251 (b)(3);
10 (b) Section 2 -251 (b)(4);
11 (c) Section 2 -251 (c)(4);
12 Section 2. Severability. In the event any title, subtitle, section, subsection, subdivi-
13 sion, paragraph, subparagraph, item, sentence, clause, phrase, or work of this ordi-
14 nance is declared or adjudged to be invalid or unconstitutional, such declaration or ad-
15 judication shall not affect the remaining portions of the ordinance which shall remain
16 in full force and effect as if the portion so declared or adjudged invalid or unconstitu-
17 tional was not originally a part of this ordinance.
18 Section 3. Repealer. All ordinances and resolutions, including but not limited to
19 Little Rock, Ark., Ordinance No. 18,560 (December 18, 2001), and any other ordi-
20 nances or resolutions that relate to financial reporting within the City, are hereby re-
21 pealed to the extent of such inconsistency.
22 Section 4. Emergency Clause. It is imperative to assure that throughout calendar
23 year and fiscal year 2006 the City meet all of the standards that it has set for reporting
24 the City's financial condition, and that it is essential to the public health, safety, and
25 welfare, that these standards be clearly in place on January 1, 2006, at the beginning

i of the fiscal year; an emergency is, therefore, declared to exist and this ordinance shall
2 be in full force and effect on January 1, 2006.
