21550 1 ORDINANCE NO. 21,550 2 3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF A 4 COMPETITIVE SELECTION PROCESS AND AUTHORIZE THE CITY 5 MANAGER TO EXTEND A ONE (1)-YEAR SOLE-SOURCE 6 MEMORANDUM OF UNDERSTANDING WITH THE BOARD OF 7 TRUSTEES OF THE UNIVERSITY OF ARKANSAS AND THE LITTLE 8 ROCK SCHOOL DISTRICT PARTNER SCHOOLS FOR A PROJECT 9 RELATIVE TO THE CITY'S LOVE YOUR SCHOOL INITIATIVE; AND 10 FOR OTHER PURPOSES. 11 12 WHEREAS, the City of Little Rock's Love Your School Initiative is based on the Socio-Ecological 13 Model of Health Behavior Change, as recommended by the Center for Disease Control and Prevention,to 14 implement evidence-based obesity-related preventive health behavior changes in children and their 15 families;and, 16 WHEREAS,this framework guides health behavior change by implementing interventions at five(5) 17 different levels: Individual; Interpersonal; Organizational/Institutional; Community; and Systems- 18 Structures-Policies, and Love Your School has adopted evidence-based interventions that directly address 19 all five(5)levels; and, 20 WHEREAS, in 2010, the City of Little Rock was awarded a Two Hundred Thousand Dollar 21 ($200,000.00) Cities of Service Grant to develop and implement a Service Plan based upon the Cities of 22 Service Model which addressed three (3) pressing community needs identified, namely: Childhood - 23 Obesity;Neighborhood Stabilization; and Environmental Sustainability; and, 24 WHEREAS, utilizing these grant funds for the years 2010 through 2012, the City of Little Rock 25 developed and implemented the following three (3) service initiatives that addressed each pressing 26 community need: Childhood Obesity: Love Your School;Neighborhood Stabilization: Love Your Block; 27 and Environmental Sustainability: Little Rock Volunteer Park Rangers; and, 28 WHEREAS,in 2013,the City of Little Rock applied for and received a One Hundred Thousand Dollars 29 ($100,000.00) grant from Bloomberg Philanthropies Fund for Cities to extend its Love Your School 30 Program at eight(8)high poverty K-5 elementary schools; and, 31 WHEREAS,on November 15,2016,the City and the Board of Trustees of the University of Arkansas, 32 acting for and on behalf of the University of Arkansas at Little Rock College of Education and Health 33 Professions' School of Counseling, Human Performance & Rehabilitation's undergraduate Health [Page 1 of 3] 1 Education&Promotion Internship (Institution), entered into a Memorandum of Understanding(MOU)to 2 memorialize the collaboration of the parties with respect to a continuation of the City's Love Your School 3 Initiative in support of the goal of reducing childhood obesity in K-5 elementary schools within the Little 4 Rock School District (LRSD) and the Institution's Undergraduate Health Education and Promotion 5 Internship to provide high quality community service and hands-on learning experiences through Love 6 Your School for undergraduate Education,Nursing,and Health Education&Promotion internship students 7 enrolled at the University of Arkansas at Little Rock; and, 8 WHEREAS, on January 17, 2017, the City Board of Directors adopted Ordinance No. 21,357 to 9 dispense with the requirement of competitive selection process and to authorize the City Manager to enter 10 into a one(1)-year sole-source MOU with the Institution and LRSD for a pilot project relative to the City's 11 Love Your School Initiative. This Pilot Project MOU was executed on March 10, 2017. Under this Pilot 12 Project MOU, the Institution provided up to thirty-six (36) student interns to serve as Love Your School 13 Coordinators at up to twelve (12) designated LRSD K-5 elementary partner schools in order to assist the 14 City with the Love Your School Initiative. 15 WHEREAS,the City and Institution have evaluated the services provided under the Pilot Project MOU 16 and now desire to extend, by one (1)-year the Love Your School MOU whereby the City, the Institution 17 and LRSD Partner Schools enter into a one(1)-year sole-source MOU extension in furtherance of the Love 18 Your School Initiative. It is not feasible to engage in a competitive selection process for these services 19 relative to the Love Your School Initiative because only one known source exists for these services as 20 determined by documented research; no other feasible alternative source exists that meets Love Your 21 School requirements; only one(1)source meets the business needs of the Love Your School Initiative due 22 to the compatibility and unique features of the partnership between the City, the Institution, and LRSD 23 Partner Schools. 24 WHEREAS, pursuant to this MOU extensiuon, the Institution provided student interns to serve as 25 Love Your School Coordinators at up to eight(8)designated elementary schools in LRSD in order to assist 26 the City with the City's LYS Initiative; and, 27 WHEREAS,the City and Institution have evaluated the services provided under the initial MOU and 28 now desire to extend the Love Your School Project whereby the City,the Institution and the LRSD Partner 29 Schools will enter into a sole-source MOU extension for one(1)-year in the furtherance of the Love Your 30 School Initiative. 31 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 32 OF LITTLE ROCK,ARKANSAS: 33 Section 1.The Board of Directors finds that a competitive selection process should be dispensed with 34 and the City Manager is authorized to extend the one(1)-year sole-source MOU with the Board of Trustees [Page 2 of 3] 1 of the University of Arkansas and LRSD as follows: University of Arkansas-Little Rock: Funds required 2 for up to thirty-six(36) student interns to execute the Love Your School Initiative during the 2017-2018 3 Winter-Spring Term (January 2018 through May 2018) and the 2018-2019 Fall Term (Mid-August 2018 4 through Mid-December, 2018), in an amount not to exceed One Hundred Eleven Thousand, Seventy-Two 5 Dollars($111,072.00); 6 B. Little Rock School District Partner Schools: Funds required to execute the Love Your School 7 Initiative during the 2017-2018 Winter-Spring Term(January 2018 through May 2018)and the 2018-2019 8 Fall Term (Mid-August 2018 through Mid-December, 2018), in an amount not to exceed One Hundred 9 Fifteen Thousand,Four Hundred Ten Dollars($115,410.00). 10 Section 2.Funding for these services is available from Account Number S 10A915. 11 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 12 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 13 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 14 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 15 ordinance. 16 Section 4.Repealer.
